Who's at fault exiting a parking lot?

I was exiting a parking lot, which you can only turn right as there is an island straight ahead. The exit of the parking lot allows for one vehicle to exit and one to enter. Upon my exiting and turning right, another vehicle pulled up next to my right and so when I turned, my rear right door made contact with his left front bumper. The insurance company first found no-fault, then changed it to my fault with a charge negligent right turn and failure to maintain proper lookout. What?

I was exiting a bank parking lot and the only way the other vehicle could have pulled closer to mine or between my vehicle and the curb would be to cross and stop over and on a fire lane, would that change anything? How can two cars turn in the same direction? There was no designated or division of lines for entry and exit. I was following another vehicle in front of me and they were in the same position. I agree that this *** was impatient! I was getting ready to make a complaint to the Dept. of Insurance when my insurance now wants color pics as no one came out to investigate the scene. Do you think I have a chance to convince them otherwise?

Your description of the accident was unclear.

If I understand correctly, you were turning right out of a parking lot (and this was the only direction that you could have turned), and during your turn a vehicle came from BEHIND YOU FROM THE SAME PARKING LOT and struck your right rear.

You need to do your OWN scene investigation since your insurance company does not appear to be advocating on your behalf. There are two issues here:

RIGHT TURNS VC22100

(a) Right Turns. Both the approach for a right-hand turn and a right-hand turn shall be made as close as practicable to the right-hand curb or edge of the roadway

PASSING ON THE RIGHT

VC21754. The driver of a motor vehicle may overtake and pass to the right of another vehicle only under the following conditions:

(a) When the vehicle overtaken is making or about to make a left turn.

The provisions of this section shall not relieve the driver of a slow moving vehicle from the duty to drive as closely as practicable to the right hand edge of the roadway.

Of course, this is CA vehicle code, I have no idea where you are. You could make the case that there is shared liability, or you could make the case that the other party was at fault for unsafe passing.

Two vehicles cannot occupy the same space, so unless you were in REVERSE, then the other party HIT YOU. Or I guess it is possible that the other party pulled up in a manner that prevented you from making a turn without striking his car. Which would be really stupid.

Your description seems to be missing something, and you are probably at fault based on the position of the impact. If a car ran into your right rear door, and you were turning right, then apparently you were turning right with a car in your "blind spot" inside to your right. You are responsible to check your "blind spot" either right side mirror over look over your shoulder you should have seen that car before you turned.

You are always responsible for the path your car takes. If you couldn't have made the turn without hitting the other vehicle you need to adjust your attack on the turn. If you were not moving and the other car was then they hit you. If you were moving and they were not then you are at fault.

If I understand this correctly....you pulled out of the parking garage, and merged into traffic.

At which point, you hit another vehicle.

How would it be anyone else's fault but yours?
