Who's at fault for this car crash?

You are proximate cause for the accident for unsafe backing. The illegally parked car contributed. You're roughly 75-90% at fault. Be glad it wasn't a child playing in that area or a pedestrian.

Well, you are supposed to check before you back. What if it had been a child, perhaps on a bicycle? So that starts with it being your fault. But some percentage of fault *might* be transferred to the other vehicle for parking in a fire zone.

About all you can do it turn it over to your insurance company, and let them figure it out. If you're lucky, the other person didn't have insurance and that would automatically make it his fault in California. If he did, just let the two companies argue it out.

OK you didn't see it and you hit it. So, apologize and pay up. The fact that the other person was parked wrong doesn't give you the right to hit the car, even if you didn't see it. Two wrongs don't make a right. Now, talk it over and convince the other person to "share" the blame, but do it with a good attitude because it may turn into a violent shouting match. If you still think your are right and feel upset, then talk to a lawyer.

You are at fault because you are supposed to have control of your vehicle at all times.Whether he parked in a blind spot or a fire zone or whatever,You are not supposed to move your vehicle if your view is obstructed! If a child was in the street and you hit him,are you not at fault because his parents were not watching them?

I am pretty sure it is not your fault but he may try to claim it was since you were backing up. But if he was parked illegally then it IS his fault. Hope I helped!

It's the other car owner's fault. Illegally parking out of your line of sight in a fire lane is against the law in any terms. The person should have never parked there in the first place. If you have evidence that the person was parking in the fire lane before you crashed into him/her, then they will be liable.

it is his/her fault. what do they think they are to park on a fire line. it is there for a reason. you should not care that it is too crowdy just dont park there. why are THEY SO DUMMM!!!! just becouse it is to crowdy does not mean that they have to park there. tell them that dont park there and it is P R I V A T E P R O P E R T Y ! ! ! ! ! ! he started it so its his fault even if it is your fault, he should not have parked there. people these days. so it is NOT your fault.

yeah its the other guys fault i mean ur not suppose to be parking in a fire zone anyways. i know you did the damadge but think of it this way, if he didnt park there none of this would have happend

same thing happened to me pretty much. i live in tx and my neighborhood is labled private property. at the end of the culdesac i live in, is a firelane and no parking allowed my neighbors guest parked directly behind his car leaving me limited space to back up and curve around enough to get out of my HOMES parking space. while attempting to do so i barely clipped the morons worthless car and he wants me to pay him screw him. this is my home you know how dare you ask me for crap when blocking MY vehicle in MY culdesac at MY house,visitor parking is at front of neighborhood if you cant park with courtesy then park where your allowed !!!
