Who's at fault in this accident?

So i was driving with my girlfriend in my truck, but she was the driver. We stopped in a parking lot for her to get her truck which was in the parking lot. I got out and another truck backed up into my truck while my girlfriend was still in the driver's seat. I'm pretty sure it's the other driver's fault but I just want to make sure. Also is my girlfriend being in the driver's seat of my car going to affect anything?

Were you stopped in a parking spot or in the middle of the travel lanes? If in a spot then it is the other driver's fault and it shouldn't matter if your GF was in the driver's seat. If in the travel lane then it may be your GFs fault and her being the in the driver's seat may affect insurance coverage since she put the truck there. Call your insurance company to make sure.

if your car was not moving, it is not your fault regardless of where you are. It will be hard to prove though unless the other guy admit that your car was not moving or if you have a witness who saw that your car was not moving.

Let's put it this way, someone parked their car in a dark highway. I was cruising along and slammed into it. The cops said it was my fault since I hit an object not in motion and that I had the last chance to avoid the accident.

yes if she was in the seat your insurance will probably not cover it since shes not under your insurance so that might be a problem but you are not at fault its the other person

The guy that backed into you is at fault, regardless of who was in the drivers seat.

If your truck was at a complete stop then the OP is at fault. The OP's liability will pay for your damages. The fact your girlfriend was driving is not an issue. She was driving with your permission.
