Who's at fault the car or me?

i few days ago i got hit by a car. well what happen i had got out class and was on my way to go by textbooks across my collage. I went to the light and saw when the cross walk man appeared so i started to walk. then suddenly the young women that was making a right turn onto the crosswalk i was crossing hit me. I didn't blank out , but i was thrown and fallen onto my back. I guy that was crossing the crosswalk with me on the opposite side of me called 911. the young women did stop and a report was done , but who had the fault?

Yes, pedestrian had right of way because she had to make a turn. Your crosswalk light was on too, and you were in a cross walk.

The driver that hit you is at fault. Pedestrians usually always have the right of way. Especially if you are in a cross walk.

Umm, it's a no brainer, no offense lol...It was the car's fault lmaoo...Anyways, if the car ran away and you have no liscene plate number, no nothing, then you can't track that person. Always keep in mind...You have the RIGHT to pass it is green, the person making the right has the right to make a right turn but must make sure there are NO pedestrians crossing, finally even IF you were illegally crossing it doesn't matter because the rule says "Pedestrians have the RIGHT OF WAY". In this case the pedestrian had the right of way. So, legally it is the cars fault.

However, reality is it is equal blame. Each person involved should be able to pay attention to their surroundings and avoid the collision.

Some Pedestrians (I am not suggesting you are this type) believe that all cars will follow the rules. But, well, if they make that assumption they may get hit. Some drivers believe that no pedestrian has the right of way while on the road, and well, thats the driver licensing office's fault for giving these people licenses.

In some cases though, real accidents just happen, and in yours, the driver is at fault.

A pedestrian always has the right of way while they are within a crosswalk, but the pedestrian should also make sure that they are not DEAD right!

The bottom line is that the pedestrian's injury might have been prevented by the pedestrian being more careful, and that the driver of the vehicle will be legally at fault.
