I'd a car accident. The driver of the other vehicle isn't the owner of the car. He's the worker at the commercial property, the accident took place at the commercial property. Who is responsible in the case? The insurance of the commercial property or car insurance of the other vehicle, or both in this case?

If the driver was in the course and scope of his employment and had permission to use the vehicle, the commercial property owner's insurance company would provide coverage to the driver. He would be considered an "insured" by definition under the commercial auto policy. The driver's personal auto would likely deny coverage if he was working at the time of the accident, but that would be subject to interpretation of his personal auto policy.
Call the commercial property's insurer and file a claim. They will complete an investigation and let you know if they accept liability. |

who owns the vehicle has nothing to do with fault - sounds like a fender bender in a parking lot - and the insurance companies duke it out determining fault and often ea side just pays their client as fault in a parking lot and on private property is very difficult to prove
police will not ticket any accident happening on private property so don't look for help there
if the insurance companies find that the other driver acted reckless or neglegent then the business' insurance will pay for your repair, otherwise you are stuck with it or your insurance company is - and you have to pay the deductable
sorry for the bad news but private property wrecks are just a huge gray area |

It depends on who's at fault, it has absolutely nothing to do with where it took place and the fact that he wasn't the owner of the vehicle, & everything to do with who caused the accident. |

It would be the insurance comapny that the companys vehicle is insured with not the company itself. in an aotu accident the insurance company has full liability in the auto not the person's place of business. |
