I was pulling into the starbucks parking lot (its actually a little strip mall but Starbucks is in it) and as I drove past the gym a guy backed out into me, he hit the drivers side door right where I was, it got dented in but i'm fine. He backed out pretty fast thinking no one was there, whos fault is this?

You had the right of way. He was parked, and backing onto a "road" (For a lack of better words), and hit you. You had the right of way. |

he is probably mainly at fault but it might be said you should try and anticipate what the other driver might do always expect the unexpected as they say |

If you didn't call the cops to establish a written report of the accident, your insurance company will consider this a situation in which the two parties are equally at fault, and will fix your car. However, if your damages are less than or near your deductible, you should get the repairs done yourself and not file a claim, which will likely cause your rates to go up. |

The fault is more than likely his. It was his responsibility to make sure the coast was clear before backing out of a parking spot. The only thing that might get you for partial fault would be that you weren't going the right direction down an aisle way or driving over the parking lot speed limit. But I wouldn't be too concerned about it. |

He is probably at fault, if you were driving at a reasonable speed. May sure you call the cops. |

As long as you got hit BEFORE the rear wheels, he should be at fault. Talk to your insurance agent. They'll know what the regs are on this. |
