Who is at fault in this accident?

I witnessed a car accident in a parking lot

Car #1 was pulling out of a parking space and then went forward down the asile, towards the exit. It was going to turn left and was slowing down to turn, (there was no stop sign unfortunately), (and also every parking space was full, decreasing visibility) and #1 began to pull out a little into the main lane when another car (#2) came zooming down the middle of the road, leaving no place for #1 go, except to slam on the brakes. #1 hit #2, scraping the whole passenger side of the vehicle.

#1 could have yeilded better, and not stuck out a little
#2 could have been going slower, and not driving in the right lane (pretty near)

Who is at fault?

Probably # 1 but the insurance company is the only one who can determine fault as to who pays for the damages

most witnesses are not biased, nor know either car 1 or car 2, but you are giving your opinion?

it sounds like car 1 pulled out and car 2 was there. car 2 may have been driving too fast in a parking lot; car 1 has a visability problem like in any parking lot due to suvs, trucks, vans etc. you cant see to the left or right many times due to the vehicles. the fact that car 2 damages are scraped on the entire passenger side is odd;

the fact that there is no stop sign, makes no difference, you still have to verify no cars coming either way prior to pulling out. sounds like car may have just tried to turn without verifying clear.

this will be sorted out by the insurance companies; most likely since in a parking lot, will be decided 50/50;

From what the above states it sounds like car 1 (sounds like you or someone you know) was going too fast when "pulling out a little" or they could have tapped the brakes to stop instead of "slam on the brakes" if they were just creeping out to see if a car was coming. And 2 was wrong for driving down the middle and also going too fast.
I say both are at fault there for driving too fast. 50% each. Or maybe even 60-40 car 1 being 60% I guess you will have to see what there insurance settles on, they will duke it out.

Car #1 is at fault I believe for failure to yield to Car #2. But if Car #2 was driving excessively fast in the parking lot, they can share some blame. I would say 60-70% fault for Car #1 and 30-40% fault for Car #2.

My police officer boyfriend says that the driver who had the biggest thoroughfare would have the right of way. Therefore car #2 who was pulling out is at fault.

1, for sticking his front end out. #2 was driving down the main lane. #1 was trying to enter the main lane from a side aisle. #2 clearly has the right of way.

50/50 fault.
Car 2 was going too fast and taking up 2 lanes
car 1 entered a drive from an isle when it was not clear.

if car 2 was in the middle of the 2 lanes( taking up both lanes) i believe it would be car2's fault.
