I was backing out of my parking spot at work and I didn't see this machine thingy in the parking lot. Long story short, I hit it and now there is a big dent and scrape on the side of my car. I've asked the people next door to us to stop leaving there things in the middle of the parking lot and they still do it. Who is responsible for paying for the damage to my car? Additional Details oklatom and what if it was a child? Thank god it wasnt. This is called an accident! Just incase you don't know what accident means here ya go:

Legally, your responsible but since this sounds like it's an ongoing problem with the people next door, try to talk to them and see if they can help pay. Good luck |

if you hit it, it is your fault, you are responsible for any damages to their equipment as well as to your car. Any contact you make with a non-moving object is your responsobility. |

who was driving your car is the one who is responsible for paying for the damage if they was backing up and run into something then it was driver |

If you backed into something that wasn't moving but just sitting there even if it didn't belong, you're the one at fault. Be more careful next time. |

Who should have to pay? The person responsible. Who is responsible? You are. "I was backing out of my parking spot at work and I didn't see this machine thingy in the parking lot."
You have a responsibility to not back up unless you can see that the path your car is about to take is clear. What if it had been a child?
If you have collision coverage, your insurance will pay, less your deductible amount. If not, you are responsible. |

I hate to break it to you, but you are at-fault for this. You're driving a car so you have a huge legal duty to make sure the path of your car is clear. Just because you told them to stop leaving their junk in the parking doesn't mean you no longer have to be aware of what is behind your car.
BTW, people are at-fault for accidents. Just because it was an accident doesn't mean somebody isn't at fault. You are at-fault for improper lookout while backing. Therefore, you are at-fault for this. Any insurance that the owner of the thing you has won't pay you for your damages.

I agree with oklatom. You failed to keep a clear look out. No matter whether that thing is supposed to be there doesn't matter. It is still an inanimate object. You knew it was there, you could see it. If you couldn't get out safely you should have called the police and had them get it towed or something, not just back into it. I think the point oklatom was making about the child is that if there was a child standing in the parking lot where he wasn't supposed to be and you hit him,you would be at fault for not keeping a proper look out. Just because its a machine doesn't change things. |

I'm sorry my friend but you are at fault. You hit a stationary object and failed to maintain a proper lookout to the rear.
Insurance adjuster use the child analogy to get people to understand better. while you hit an object if you had hit a small child would you feel the liability was different?
