Whos insurance would cover this?

Time to get on my soap box. First off there is not much money making in insurance. You have to plan for the future claims some companies do a good job, some don't. Please don't think that all companies are like AIG. THEY'RE NOT!!!!!!!!! AIG was stupid and made marignal financial calls at best and got caught, BIG TIME. Also they are more on the life and medical side than your typical insurance companies.

Second, insurance companies DO NOT care if you contact an attorney. Sometimes we prefer it as we no longer have to talk to you. And of course he is going to take a third of what you have coming to you and could have gotten on your own instead of listening to really, really bad advice (Trouble) from people who have no idea of what they are talking about.

As an adjuster my job is to evaluate claims based on fact. Fact is sometimes deceiving though. I have my insured's version and the other party's version. IF the versions do not add up then I complete my investigation and make a liability decision. If after all the evidence is secured and I cannot make a decision it is basically word vs word. I don't look forward to this, its not easy to tell someone that i cannot help them. but this is how it works. I will take my insured's side if there is no evidence (proof) to show otherwised. And your insurance will do the same for your.

When you have an accident is not a matter of who hit who. It is a matter of who is legally liable. Just because someone hits you doesn't automatically mean that they are at fault. if you run a red light and you're creamed by the other party, they hitting you, you're still at fault even though they hit you on the side. See the difference.

Now to get to your accident. If she was indeed hit from behind then no, she would not be liable to your damages. She is just as much a victim as you are. Her insurance company will do an investigation to determine if their driver was negligent.

Your other option is to let your insurance company handle it and do their own investigation. You would be out your deductible for now but hopefully they can get that back for you.

Her insurance would cover this and all you need to do is turn everything over to your insurance company and they will investigate this for you........at this point her insurance company is playing hard ball and hoping that you will go with what they say.....

DON'T BELIEVE Her Insurance Company.......
NO MATTER, She HIT you, She is in FAULT.....Her Insurance should PAY for your Damages.....
NOTE: Insurance companies are in the Business to MAKE money and 'honestly' HATE to pay out Claims......Just threaten them with a Lawsuit!
IF worse came to worse and she WAS hit from behind, which you say it doesn't appear to be so, then the person who hit her will ALSO BE AT FAULT! (Obviously, you said, there was NO OTHER Car behind her )
BELIEVE ME, get a 'legal' opinion.......Does the Name "AIG" sound Familiar...they are an INSURANCE Company...(They are ALL, Thieves)
