Why is it that after a car accident, I have to fight with the insurance company just to recieve care?

Im in ny and was rear ended by a drunk driver going 80 mph. I was stopped. she totaled the car and have been having periods where I pass out and am in tremendous pain all the time. besides my lost wages which is another fight. why is it so hard to recieve care?

I bet it's not REALLY so hard to receive care. You're not talking about your MEDICAL CARE that you're having a hard time with, you're talking about getting MONEY from the other person! Here are some possible reasons:

1. The tort laws in your state - because it looks like you have soft tissue injuries, nothing "hard"
2. Your policy - if you don't have lost wages coverage on your own policy, it' snot going to be easy to collect them. Not to mention, you have to not be able to work, ACCORDING TO A DOCTOR.
3. Her policy limits - her insurance will NEVER pay more than the policy limits.
4. A laywer. IF you hire one, it will DRASTICALLY slow down the claims process.
5. Her coverage - it's possible she has no coverage AT ALL.

You need to ask YOUR AGENT for help, that's specific to your case, your state, and your coverages.

You want to know why many times it's dificult to get a hold of your adjuster? By chance did you look for the lowest cost insurance? They offset that cost some how.

Most people don't shop for insurance based on the service they are going to recieve but then don't expect top notch service either.

NY is a No Fault state with $50,000 toward medical bills and 80% of loss wages (as far as I see). This means your _own_ carrier will pay the 1st $50k in medical expense. As there are doctors on every corner... they _will_ offer treatment and just bill your insurance company. Have you even asked any doctors about this? They do it _all day, every day_.

In addition to your own carrier paying the above mentioned amounts, the other person's carrier should address any additional medical bills/loss wages. Lastly, the other carrier should also consider "pain and suffering". Of course, the other carriers compensation will require a release from you.

If you can't reach your adjuster, ask to speak to that person's supervisor. Go up the chain from there. If still no cooperation, contact your states Dept. of Insurance and let then know your not getting any cooperation and your carrier is refusing to offer No-Fault coverage. This will light a fire under their butts.

It isn't difficult at all to recieve medical care in this country...go to the doctor and GET IT! The insurance company is probably having difficulty with YOU...you think you were hit at 80 mph and lived. Wrong. They would be scraping you up with a spoon if your vehicle were hit at that speed. Stop depending on insurance to care for you. You need to take matters into your own hands, get well THEN deal with getting paid.
