Ok, I was in a wreck tonight, rear ended mind you it wasn't at all my fault and the other girl admitted it. We got her insurance information for everything as well. My car will be totaled I am sure, it was messed up bad. As hers was. The thing is my insurance doesn't take affect until Midnight. I switched carriers today as a matter of fact(i know go figure) and so technically when I was hit I had nothing. With this being her fault, even the cop telling her that, will I get screwed because I was in-between insurance policies? Additional Details let me also add that we had witnesses that saw the whole entire thing stating it was her fault completely.

While it was silly to drive without insurance, the other party is legally liable for your damages. Are you absolutely positive that neither one of these policies will cover you for the damage?
Anyway, call the insurance company and file a claim. You should have no problem unless you live in a state with the No Pay, No Play Statute. However, this statute usually limits non-economic recovery such as "pain and suffering". |

Did the cop give her a ticket? She hit you from behind so automatically it's her fault; following too closely.
You should be covered under the previous insurance company until 11:59pm and then covered by your new insurance company starting at 12am. You should be fine with insurance coverage. You can call them just to make sure but I'm sure that's how it works. |

You should probably get a ticket for driving without insurance. However i don't think that it will matter if she was at fault, just sue her for damages to your car. Her insurance company will end up paying for the damages. Just because YOU don't have insurance does not mean that SHE gets off scott free. If you car was parked in the driveway and she plowed into it totaling it, she is still liable for the damages. |

Ok. You will get a ticket for driving with no insurance if you are in California. But, being as she was the one at fault her insurance will have to pay because she was 100% liable. They will also most likely offer you a lame 1500.00 settlement. You may have to get an attorney if you are hurt and start liens. |

Well, if you get her to pay cash your good... if you have to bring it up with your insurance, they might look into it a little bit more (insurance companies don't like to lose money). I would really try and avoid the insurance companies if you can. |
