Will the insurance company declare my car totaled ?

Well, someone hit my car yesterday early in my parking lot, (((seems to be a DUI, not sure!))), the police came and fill the report... now we sent the car to the body shop and they said that the repairs will cost around $ 12.000 maybe more.... Now, the car price was $ 25.000, we bought it 2 years ago and we checked in the blue book the actual cost and it is around $16.000... my question is, do you think the insurance company will declare my car totaled ???

The body shop guy told us that the car will lose 70% of his price because of the accident even if it is repaired...

If the car will lose 70% of his value if it is repaired, and the insurance company decide anyways to fix it, what we can do ???

Pd. The hit wasn't our fault at all, it was in our parking lot and this crazy drunk driver just run over it :(...

That is untrue. If your vehicle is fixed to as good as new shape, where is there any loss? Your two year old door is replaced by a new door, and your car is now worth 70 % less? I'd go find another body shop if it were me.

But the insurance adjuster will look, and make his report, and then the insurance will decide which will be less expensive for them, fixing your car to as good as new, or giving you fair market value and taking your car.

What can you do? Wait until they make a decision and an offer, and either take it or reject it.

By the way, blue book and fair market value are not the same.

There is one thing you can be absolutely certain of - the insurance company will do everything in their power to minimise their loss.

Even though it was a drunk who hit your car and you are not at fault, the drunk driver's insurance company will not cover him because he has driving illegally (ie over the legal alcohol limit) so his insurance is null and void.

So, based on the information you have given, the most likely scenario is your insurance company will repair your car for the $12,000. If the Blue Book is $16,000 and you are insured for "market value" then they will not write your car off ($12,000 < $16,000!). If the cost of repairs gets closer to the $16,000 value they MAY decide to write it off and give you a check fro $16,000. Remember this - the insurance company will ONLY ever act in their interests - they will not give a hoot about you even though you are not at fault and have done nothing wrong.

Finally you better hope you have told your insurance company that your car is parked "in your parking lot" assuming this is where you park your car when you are at home. If you have not told them then they will use that as a loophole to get out of paying altogether. If this "parking lot" is at your workplace, shopping centre etc then it's ok. Good luck.

If the damage is over 50% of the value of the car then your insurance company will probably total it. The question is, do you know who hit your car? Do you have their insurance information? If so, then your insurance company will go after the driver's company for damages.
