I'm thoroughly confused at what to do...I have a part-time job at a retail store. An object fell off the shelf and hit me over the head giving me a concussion and issues with my neck and back. Their doctor said I could go back to work with limitations - can't lift over 10 lbs and sit for 10 minutes every hour and placed me under physical rehab for two weeks. I'm paying for my own chiropractor since WC doesn't recognize them as being legit. She took me off of work for two weeks. I'm going in for evaluations with both of them later this week. My boss told me if I was released with limitations she would keep me off the schdule until I could come back fully.
This is my dilemna. I was offered an office job somewhere else where I won't have to climb ladders and carry heavy objects. I accepted and will start this coming Monday. I want to be totally legal and honest in what I do next. I'm just confused about the steps I need to take first.
Do I tell my retail boss I'm quitting after my evaluations, and if I do will that jeapodize any of my benefits? Or should I go ahead and try to work with them like on Fridays one day a week, if my boss will even let me come back, while working the new job Monday through Thursday? I don't even think my body could go back to work at the retail store yet honestly. I just don't want to do something that is dishonest.
Please advise...

In the US, employment is almost always at-will. You can quit whenever you want, just as they can fire you whenever they want. As for the WC, find yourself a worker's compensation attorney - it sounds like you have a legit case and they can tell you for sure. Your claim won't disappear if you quit, so go for the job that won't be causing you pain and let your retail job know asap. Best of luck. |
