I was in a wreck last night, I have no liability insurance, I had the proof of Insurance that I gave to the officer, but he gave it back, I didnt get a ticket, what had happened was I was driving along the highway and all of a sudden out of nowhere a car swerves around sort of like he was doing a u-turn, and I was driving the speed limit which was 40 mph, and I said OH MY GOD, and slammed on my brakes, and had no choice but to hit him, the guy was DRINKING!!! My car got totaled Im sure because the front end was awful, something was leaking also. Anyways will I still be able to get anything from his insurance, if he has it, HOPEFULLY HE DOES!!! since I do not have liability? Since he is at fault, I would assume that he would still be liable. And the cop told me to have my insurance company call and he would fax the police report to them. Can I go to the police station and just pick up the report and get ahold of his insurance? PLEASE HELP!! IM VERY STRESSED!!!! IM ONLY 19 YEARS OLD!!

Yes your vehicle is still covered if it is proven that he was 100% liable. It doesn't matter if you didn't have insurance, which you should btw. |

There are several possibilites. You can expect to receive a delayed ticket for driving without insurance. His insurance should still cover your damages, but you'll lose some of the compensation to fines. It's also possible that since you weren't insured, his insurance will probably cut 50% off your compensation as you should not have been on the road without insurance. You can get a copy of the police report but it won'd do you any good. His insurance needs an official source of the police report. It's too easy for you to make changes to the report and send it in. You are probably SOL. |

Do what the cop said and have your insurance company get the report. Since you weren't ticketed the fault is with the other driver and your insurance company can go after him for your repairs. Go to the doctor too to get checked out. Alot of times you don't know you've been hurt until you're in pain a day later. The other driver is totally responsible and you should be compensated completely. May take a while though. |
