they dont have a right to total your car, unless you agrre to their payment to you for the car. Just because it was involved in their clients accident does not make it their car. That sounds like theft. Write a separete police report, and sue them for theft
The reason i wrote that is, it's clear the other person is at fault and should pay.
Your insurance can keep the car, if it is totaled, and you agree. But remember, it's your car first. |

Regardless of whose fault it was you must report this accident to your own insurance company. |

If another person hits your car, they are at fault. Your insurance will total your car and give you a check for its blue book value. I hope you don't owe more than it's worth, or else the check won't cover the amount you will have to pay off for the loan. That's where "gap insurance" comes in. That will cover the difference. Regular auto insurance doesn't cover that. |
