How much time do you get for 2nd degree of forged instrument if you got a check in the mail from a frodulant bank & the person that cashed it wants to drop all charges even though you are summons to court anyway??? Asking for a friend... Really just worried for a friend... & going to update them on what can happen.

It depends on which state your friend is in. I can only comment on California Law against forgery (Penal Code 470)
The forgery and fraud charges can be punished by 1 1/2 to 3 years in jail, if the prosecutor decides to charge your friend with a felony count.
Whereas a misdemeanor charge carries up to a year in jail. If the check involved was for less than $200, your friend will generally be charged with a misdemeanor. Your friend should get a lawyer. |
