It could be either. It depends on the elements of the case or the facts leading up to it that will determine the appropriate charge. It also depends on whether the boy was injured (broken nose, etc).
It could be domestic assault and/or violence because they reside in the same home. It could also be child abuse (coined "malicious punishment of a child" in my state) if the events leading up to it meet the elements of abuse.
Regardless, it is my opinion the father should be charged. |

Depends on what state you live in. In the state of Delaware, CHILD ABUSE.
Personally, I think it's child abuse.
This is an extreme form of discipline and it is violent. Why would any good parent go to these extremes to 'teach their kid a lesson'.
I think the father should be prosecuted. This doesn't teach anything but violence and assault. |

Touchy subject. The son could press charges of assault and/or battery. There are so many unexplained variables here that it is impossible to say. Are there witnesses? Did the son swing first? Provokation? etc.... |

It's both. Domestic Violence is a broader term that can apply to the whole family while child abuse refers to violence upon a person's children by them. |

"Domestic violence on a minor child", IS child abuse, but it implies the child is over the age of 14. Simple "child abuse", is used for children under the age of 14, according to the authorities in California when my 16 year old child actually did receive a broken nose at the hands of my ex-husband. Because the child admitted to being intoxicated, the father was never charged! Since the child was only visiting the father in a different county, that county said the child could be treated as a tresspasser & the father was within his rights to hit the child to restrain them while illegally intoxicated! Talk about a warped sense of values & sh*t! Adults should not be allowed to loose control on a minor child & should face prosecution for acts like this! You can subdue a child without punching them in the face. |

Why did the father punch the son?, when I was 15 my friends and I got arrested for stealing beer from a convenience store, when we got home my dad beat the tar out of me. It was the first time he did it and I never stole anything after wards. Also when I was 15 I had my dad by 2 inches and 20 lbs and I was a wrestler, football player, so it wasn't like I was a defenseless little boy. I totally deserved it......Was it a first time punch?, if so , I gotta wonder what Jr did. If its been going on a while, call the police. |

The kid was probably drunk or on drugs and swung at the father first. So I call self defense and have the kid locked up in rehab. |

domestic violence is an act that happened that does not need to be proven ... the proof is the victim.
child abuse needs to be proven that there was malicious intent or prior charges or complaints and then gets investigated. They pull the child out of the home and ask questions maybe even put your father in jail for the night? |

isnt child abuse in the catagory of domestic violence. anyway it is child abuse i would say be cause it is dealing with father and son. if he was 18 it might be domestic violence. |

Depending on what state your are IN- childs age vary.
If this is proven to be an act of violence and not a mistake- "rough housing" the boys play rough you know.
Police and CPS should be contacted to investigate.
Domestic Violence- Yes
Child Abuse- Yes
It is the adults responsibility to conduct themselves in a mature manner. |

It's both. Domestic abuse comes in many forms, whether it's spousal, parental, siblings, etc. because it involves people who live together. It would also be child abuse because it's abuse towards a minor. |

Depends on the situation... if the son is being violent as well, it would fall under domestic violence and either be assault or self defense. If the son is just sitting there or simply running his mouth it would be child abuse. |

This is child abuse. He is under the age of 18 so he's a minor... and there is evidence to support that he was hit... because of the nose bleed. However, if a social worker cannot see the bruises, there is nothing they can do. How do I know? Because I am a licensed social worker :o) |
