A police officer came to my job to ? me PLEASE READ?
|
Today at work, a police detective came into my office to question me about some matter that he believes I have a part in. He has extremely rude, swearing at me non stop, constant threats and so on..... Well, I was fired because of this, can a police officer do this? What can I do? I have not been charged with ANY crime in my whole life. Additional Details Thanks for input guys, to all of you that are talking #$&^#, go die

The police have the right to question you about any criminal activity that they believe that you are involved in. You also don't have to answer them. So, if you did something, you should probably either consider yourself lucky that you weren't arrested, or prepare yourself for the worst and get ready for your pending arrest. You were at work, and not 'in custody' so the Miranda warnings aren't necessary.
Also, for all of those folks who are telling you to make a complaint against the detective, I hate to break it to them, that the police do not have to be nice (or polite). And, it is quite legal for the police to lie to a suspect. Again, a lot of this depends on whether or not you are actually involved in some illegal activity. If you did something, and just haven't been charged, use you head and just keep quiet. If someone else ends up being arrested for the offense, it would be worth your while to make a complaint. If you are 100% innocent (not just clear in your opinion), you got a bum deal.
The police can do exactly what they did. If you work in an 'at will' state, your employer doesn't need any reason to fire you. (You are employed at your employer's will). The only thing they can't fire you for in an 'at will' state is discrimination (racial, religious etc.) otherwise, you have no recourse. Most states are 'at will' states. Now, if the illegal activity is reported to have taken place at your office, your boss would be justified in firing you, if that were true. Only you know this, we don't.
Being charged with a crime, and having committed a crime are two VERY different things. If you did something, and have gotten away with it........ then you should opbtain the services of a good criminal lawyer and ask his advice on your next move. |

1) Next time do not talk to him and direct him to leave immediately
2) If you really did loose your job as a result of this cops action you surely have a cause for complaint.....find a lawyer now....and start to pull together your damages |

Interesting how you skirt around the issue. You state you are accused, and say you've never been charged, but I notice you did not deny the crime you are accused of. That leads me to believe you did something wrong.
So, to answer your question, stop committing crimes and you won't get fired.
And to those that say "sue him", forget it. As long as his suspicion was reasonable, there is no grounds. |

Yes, the officer can. You could have refused to talk to him but they may have made it worse.
However you may be able to take issue with your job for firing you over this. You can take issue with your job for firing you for anything. The outcome will depend on what exactly occurred between you and this officer. Your performance before the incident. If you were an employee that brought drama to work regularly and was disciplined for it, they may have been right to fire you. If you were a model employee who never had a problem, then you may have a case.
Get your termination in writing. Make sure they are firing you for what they say they are firing you for. Consult with unemployment, (at least to get unemployment. That should make them a bit angry anyway.)
Good luck.
As far as everyone is saying about you being able to report him, my best advise on that is recognize that sometimes reporting an officer comes with consequences you may not have bargained for. (Not bashing police, just being real.) If you feel strong and with enough character to withstand possible problems that could come of this, than report. If you feel like reporting this will make your life unbearable, then leave it alone. |

i think i know it all

best you can do is report him to a supervisor, be prepare with witness statements, or it will be his word against yours and that wont be enough. |

This story sounds suspicious.
I'm sure there is more to this story.
Police don't come for nothing. They have lots to do.
People don't get fired because of one visit from the police. |

no, you can report him |

If you didn't knowing do anything wrong. Then screw the police officer and call his supervisor and read them the riot act. Then have the supervisor call your previous employer and get your job back.
Tell this detective your not afraid of him and to go pound sand.
What he was doing is scaring you into telling him something, if you knew anything.
Your employer was probably scared as well and doesn't want any part of what's going on.
Contact the District Attorneys office and file a complaint and see if they can help get your job back as well.
Internal Affairs might be another place to report him/her.
Never fear the authorities NEVER, unless of course you've done something against the law.
The part that is wrong here is you lost your job because of it. Police Officers have a right to question you, not interrogate you as if your guilty at your place of employment. They can detain you and bring you to the police station for questioning. NOT AT YOUR WORK PLACE.
Good luck and welcome to the world of corruption!
Now if you had anything to do with what the officier was questioning you about, your SOL. |

You can sue your employer for wrongful termination
You can report the officer to his superior, and then sue the city for hiring a police officer who caused you to lose your job. |

The police, in general, use these strong arm tactics because they think it will scare people into telling them what they want to hear. It works about half the time and it is much easier than doing any actual investigative work. You can get a lawyer and sue the police department. I would suggest suing them if you are in a position to do that. Keep in mind that the police are very good at intimidating people but they are generally not very smart and don't like to work very hard |

I suppose that's normal in 3rd world countries, but not in America, where you have R I G H T S . |

Yes, he can; but if he was rude and swearing you have a valid complaint to the department about him. |

This sounds like typical police tactics. No real invetigative work, just intimidation tactics. Talk to a lawyer, maybe they'll put this guy on back office duty. Clearly he is not qualified to deal with the public |

Your story sounds like BS to me.
But in case it's not. Contact the detective's supervisor and file a complaint about his behavior.
Assuming you did not have anything to do with the matter, you may want to consider suing the detective for costing you your job over something you had no part in. Do it for a small amount, just your lost wages until you find a new job. |
