He told me that I was going 15 over on a rural highway. I am not sure that's true, as I applied my breaks when I saw him and didn't look at speed. Anyway,I want to fight it in court. Any ideas on what I can use as a defense,as apparently I was speeding? I'm just not sure how fast. I know I can probably take a defensive driving course,BUT I WANT THE TICKET DISSMISSED!

What makes you think courts get in the habit of dismissing tickets for no reason?
- you have no reason other than "want"
you have no defense unless you lie (seems to be what your plan is).....which is pathetic, almost never works, and will only get you in more trouble.
If you've been driving for 30 years, you're an adult.
So act like it and take responsibility for your actions. |

You got caught speeding in another state. Are you sure you want to return to that state to fight a ticket? I know how you feel because I got my first speeding ticket on my way to work in a school zone. 35 in a 20 mph got me a face-to-face visit with the judge and a nice fine even though the lights weren't flashing and 3 other lanes of traffic were speeding faster than me. After 30 years of safe-driving and ticket free. |

With the new radar systems they have you "dead to rights" long before you apply your brakes. If you fight it, you will probably lose. But if you plead guilty and ask for leniency due to your clean record, I have seen judges just dismiss them for you as kind of a warning not to do it again. If that doesn't happen ask what you can do to get a Supervision. You will have to pay the fine and possibly do an online traffic school course, but your record will remain clean. |

Its one ticket after 30 years you can try nicely pointing that out to the judge.But my over all advice would be to pay it and move on. |

Kebert is correct as usual. You have no case. Why fight it?
First off, you admit you were speeding. Second, when you fight it and lose, and you will lose, you will have to pay court costs.
Third, a ticket in a different state doesn't affect your insurance.
But feel free to fight it, I'm sure nothing any actual informed people here have to say is going to change your mind. Enjoy those added court costs. |

It is going to cost less to pay your speeding ticket then taking it to court. A speeding ticket on your record isn't anything that is going to follow you. He def. caught you at your top speed because it has happend to me.Hope you make a good choice.... |

The same thing happened to me.
If he has a radar or laser report, then there is no defense. The report is all that is needed for conviction. If he's lost it, and it's in a computer file, so there is no losing it, then it's possible that the judge will dismiss.

Basically this is how it works. You go to court, if the officer shows up, you're guilty and pay the fine, if he doesn't you get away with it. Maybe you could try some excuse, like you were only temporarily speeding because you were trying to get away from an 18-wheeler that was driving erratically and veering into your lane. I got out of a ticket once by saying that, but it's only going to work if there was a lot of traffic on the road. If the cop knows the road was desolate, that's not a good excuse to use. And if the cop does show up to court, they're going to want to know why you didn't explain yourself right then and there at the traffic stop. |

The courts have heard every excuse imaginable. You can get a lawyer and try to beat it but it will be costly and chances are you will be found guilty. By the time you hit the brakes it was already too late. |

If you were on a rural highway, I'm assuming that you were pulled over by a County Sheriff? Based on who you were pulled over by, and by how much you want to go back to court, you could always have it dismissed if the cop doesn't show up for trial. Here's what I'm getting at: You can plead innocent by mail (so you don't have to drive all the way back to court just to enter a plea). They then set the trial date. Now: If you got pulled over by say a County Sheriff, chances are, he's not going to be able to come to "Rural Joe, USA" court to fight a traffic ticket. He's either going to be on shift, on overtime, or if he's part time for the County Sheriff, he may even be working for his other jurisdiction (it's not uncommon for cops to work for County Sheriff part time and a small town local force part time). With that said, I would say you'd have a 25% chance that this cop would show up to the trial. If the cop does not show, you win by default. |

I don't think you can win your case, plus you have to go to court out of town (expense and hassle). Realistically, the court is stacked against you! Maybe if you have GPS (Garmin or Tom Tom) that recorded your speed, you can win if the device recorded your speed at the right time in your favor. I read a case where a GPS recording dismissed a speeding ticket.
Your best strategy is to take defensive driving because this will get the ticket off your record PLUS it will save you on car insurance cost. Your car insurance premium may go up if the ticket is paid and it goes on your record. The other two benefits of a defensive driving course is that you will LEARN something about safety, and it will get you a deduction on your car insurance cost. |
