Ok here's the story. I was in VA last week having a sit-down with some people at a park at about 2:30am when a car pulls up and a 3rd party pulls up fighting with his wife. He hops out shoots the window out of the car and starts walking toward where the others in our group were staying with gun in hand. Me and my friend (who were authorized to be there at that hour) went to tell him he had to leave now. About 10 feet away he turned raised the gun and fired at my boss. It turned out to be a CO2 pellet gun, we didn't know that at the time. A struggle started as we went to disarm him of what we thought was a real gun. After disarming him he pulled a large hunting knife and cut the hand of my friend. After I disarmed him of that he pulled a large pocket knife and stabbed me in the leg. Again disarming him he ripped a handicapped parking sign out of the ground again disarmed and he quickly pulled another out and started swinging. By that time the other members of our party ran up to again disarm him. He was put into a sleeper hold by one of the friend that ran up because my friend and I were both injured and bleeding and he finally went out. The fight ended there and he left. My friend and I were both shot with the CO2 gun and cut or stabbed. The assailant had bruised ribs and a concussion. Well the problem is as follows.
1. We all pressed charges on him and he is now in jail but he is now pressing charges against me and the others for "aggravated assault by mob". The others were arrested tonight in VA.
2. Can they extradite me to VA from OH for that charge?
3. What leg does he have to stand on in regards to the charges? What action should I take?
4. It is an obvious case of self protection. He had weapons and used them. We took them and did not use them even though we could have to stop the fight. All his injuries the result of the original struggle. But then again, I know nothing of VA law.
Additional Details
Yes I was authorized to be there. I was working there and staying on the property. The ONLY people that should have been there at that time was us. He didn't "get away". We are not security or officers of any kind and can hold people. And anyone who has used a sleeper or has been in one knows it only lasts about 10-45 seconds. I wasn't trying to kill the guy, just remove the threat. The police picked him up the next day and he is in jail now. And he pressed charges against us not the police. Virginia is a Common Wealth so anyone can press charges for anything. This isn't "Murder She Wrote" so just work with the info at hand and leave the investigation to them. I'm only looking for some answers to the questions I asked.

To me he got what he pretty much deserved. But I really believe you are over exaggerating the whole thing. After immobilizing him so often and he gets away seems kind of you know unbelievable especially after a sleeper was put on him and he still walks away nobody detained him while he was out cold?
Yes he can press charges and he apparently did. Otherwise you and the others would not be charged. Yes they can have you extradited back to VA to answer such charges since it is a felony.
Another thing why was there a police report made by him and not by your party until the charges came up? |

Sorry, I'm not buying it. You were "authorized" to be in the park at 2:30. He shot the window out of the car and came toward you with a gun and you didn't call for police? You went to tell him he had to leave? He shot your friend (or was it your boss?) and stabbed you and still no one calls the police? What became of his wife? In the end he gets up and leaves?
