Am i likely to get a custodial?

Hi can any1 please help?
Whilst having a rest bite from a relationship(but still together just living apart temp)i was concerned about my 16month son coz i had a suspicion my girlfriend was seeing another man (just 2 weeks after we decided to have a rest bite) and my son had a black eye only 2 days after i left(that she never told me ,i found out only when i went to see him 2 days later)i finished work one night and i wanted to know what was going on i had a key to her house where we both lived for 2 1/5 years i went upstairs to find her in bed with another man (they were both asleep, i did not wake them, instead i gave my son a kiss and walked away. i was upset and angry i felt cheated so i took his car keys just to piss him off, i never touched his car or her's i just went home. the next day i returned his keys to the police station because i felt guilty for taking them and told them what i did. later that evening i was arrested and charged with burglary and harrasment! what will happen to me in court? this is my first offence , thanks to all who reply.

It is impossible to predict the sentence of the court, but remember that you will be tried by fellow human beings who will understand your feelings and the fact that you helped yourself to those keys under provocation. You did not force entry to the house and you told the boyfriend about your having the keys before he had a chance to fret about them. It sounds like a matter for a conditional discharge.

i do not think you are likely to get a custodial sentence.

in fact i applaud your calmness-quite a few men would have wreaked havoc given your position-they were both in bed and defenceless and to your credit you did not harm them-you only thoughts were for your boy and considering the recent headlines involving child cruelty it seems to me that you will be a good father.

explain the above to the court along with an admission of stupidity in the case of the car keys (the court will give credit to the fact you returned them to the police) and i would think a conditional discharge would be the result.

I don't think you will get a prison sentence as it is your first offence.It is more likely you will get probation and possibly community service.Get a solicitor, they will advise you about a likely outcome and help put your mind at rest....You should also expect probation to do a pre-sentence report, this will be looked at by the magistrates and will suggest an appropriate sentence.

Relationship offences are really awkward to judge. My best mate tried to shove a burning newspaper through her ex's letterbox. As he lived in a block of flats, it was considered to be a huge threat to the whole building. She was very lucky, as it was totally out of character, and her first offence in forty five years. She was sentenced to 240 hours of community service, which she has now completed. You need to explain to your lawyer that you were concerned for your son and thought it reasonable to enter the house, just to check that he was ok. I imagine that as you have been totally honest, throughout this whole process, you will be fine. If your ex has something against you, she might tell "tittle tattle tales" to her lawyer.You have to be prepared for this and make sure that you tell the absolute truth, as that is what will get you justice in the long run. If she tells a load of "porky's", she will be found out. Stick to your guns and tell the truth. If she is trying to "sugar coat" things, she will be found out. Good luck, it's about time that dads got a decent recognotion...
