Hi thank you 4 reading my question. I live in California and my bf went to see his probation officer on thursday to sign up for his anger management classes she arrested him right then and there for a bench warrant he didn't know he had.He apparently had a court date regarding domestic violence and he missed it.he thought it was on the 8th but it was really on the 6th.he is still in jail now an can not be released because he has a probation violation hold.there is a bail amount set but the probation hold won't let him bail out.he has 2 stay in there till Wednesday his court date.My question is if I present eveidence to his public defender that he does have a job and might risk losing it from being in jail and he pays the majority of the rent at our apartment. I have a job but my hours just got cut. Will the judge give a long sentence for this?

The judge won't be very nice to him because your bf failed to appear. The judge won't care what excuses he has for missing his court appearance. The state is the one that prosecutes Domestic Violence, even if the victim wanted to drop charges. It's really all about money now, and fulfilling his commitments to the court. Since he failed to appear, the judge won't be very trusting in anything your bf says. As far as you showing up in court, it's a coin toss as to whether it will be helpful. Your bf will probably have to do video court since he's already in jail. He won't be able to see you, but you might be able to see him on the monitor. Anything positive you can say about him can't hurt. So I say give it a shot. |
