In the state of VA, the penalty is up to 5 years in prison. If there is no just cause for it the ASPCA or animal humane society will prosecute for the full 5 years. It is a felony for animal cruelty. This could aslo forbid you for ever legally adopting pets and could have your pets taking away from you. |

Just so you know, its his word against yours.
Your sister's dog in his yard is a bad thing. Him saying it was coming at him is all he needs to day.
If there is a video, they may press animal cruelty charges. |

a whole bunch of legal issues come at play here.
but basically, it will he a he said she said situation.
the neighbor could claim a whole bunch of things like "the dog was going to attack me," "it was dark and i thought the dog was a person who was gonna attack me," "i thought the dog was a wolf out to get me," and etc.
i doubt he will go to jail for it
the judge will probably have him buy your sister a new dog |

yeah he can. If it doesnt look like that the dog wasnt attacking and someone besides your family can confirm it, he can go to jail and pay a hefty fine. |

He'll probably go to jail or have to pay a fine and be on like probation or something like that. Either way, it's just not enough. I think animal cruelty is just as bad as like human cruelty. The animals have no way of defense against man made weapons, like guns, neither do humans - so whats the difference? In most houses animals are considered part of the family and in most cases treated almost like a person. I just don't understand why these people that abuse dogs and cats and etc. just get away with hardly any punishment.
Sorry I'm just kinda sharing my feelings.
I hope yall can make something happen to that dude that shot the dog. He deserves some kind of punishment. But yeah, if you haven't defiantly let the cops know.

Oh, he can DEF go to jail. He can get quite a bit of jailtime for that. They are cracking down on hurting animals...let alone KILLING them! |

I've been attacked by large dogs twice. The first one got away with it. The second one didn't. If I see a large dog in my yard, I will shoot it. I've still got scars. |

It will depend on was he on a leash and is he licensed? All dogs need to be on a leash or obey the leash laws. I had a dog one time that ran into the neighbors yard[in the country] and his dog's had been eating chickens so mine got one too. The neighbor shot mine for killing his chickens even though his had blood on its face too, I asked him why he didnt shoot his too>? In some places you can shoot an animal if it is in your yard and it seems mean or is attacking their stuff.I dont think there is any law against shooting a dog that has come into your yard andif he has kids or if your dog is a pitbull or some like that most people get scared.I'm not sure why he shot the dog and i'm sorry it happened but part of the problem may be whoever let the dog run around without supervision.Did you ask them why they did it?I know no reason will seem good enough to you but try to forget it and just be a better dog owner next time..Maybe the people feel upset and sad they had to do it too?? |

You should not have let the Dog out and enter someone Else's property.Don't know what kind of Dog you have however they have teeth and can attack no matter how nice you say the Dog is.Its your fault Dog was shot.Did people know dog was not viscous. |

Yes he can go to jail. Use of a deadly weapon.
Even if you don't shoot it but take it outside it's a deadly weapon.. (States law are different)
Unless he claims self defense. But if he provoked the dog, or just shot the dog for the heck of it he should be going to jail. |
