Hi I wanted to know if mentally retarded people considered minors in the eyes of the law in the USA? For example if you assault some one who is mentally retarded yet is over 21 are you charged in the same manner that you would be had you assaulted a child or does it carry the same penalty as assaulting any average adult?

Anyone who is legally classified as mentally retarded usually has a guardian, such as a parent, grandparent, or otherwise. Yes, they are still considered adults in the USA. |
