Are the police allowed to use violence because you don't stop on your push bike when they flash their lights?
|
A police vehicle pulled over next to me and flashed its lights, I continued cycling because I had MJ in my pocket!
Next thing I was ripped off the bike, face slammed into a car, thrown on the ground with a knee in my chest.
I feel they have violated my civil rights - just because I didn't stop are they allowed to use such violence?

So, you failed to yield and obey a lawful order of a police officer, and then you get upset when you are pulled off your bike and taken into custody.
Plus you admit that you were not going to stop because you had marijuana in your pocket.
If you had just stopped, they probably would have asked you where you were going and sent you on your way. For all they knew, the reason you were not stopping is because you had just committed some crime, were carrying a weapon, or something of that nature.
You described the stop in the most extreme terms possible. However, it appears that the officers used reasonable force to stop you, since you already admitted that you were not going to stop. Your failure to yield may have led them to believe that they were dealing with someone who would offer resistance at every turn, and they were protecting themselves and (ultimately) you by getting you into custody as quickly as possible. |

Sorry dude, but you were pretty much resisting arrest/attempting to evade capture. That gives them the right to physically restrain you. They may have gone a bit over the top, but you'd never make that stand up!
Bet they took your weed, too! |

you were wrong, you didnt listen to them when they wanted you to pull over, so they can use force to make u stop |

You were obviously obstructing them under the Misuse of Drugs Act by preventing their search - also PACE allows the search and reasonable force to conduct it is allowed in both cases.
Don't be such a loser in future - give up the drugs and any other illegal activities you might be involved in.
Try looking at it from the other side - there's a job to be done to benefit society as a whole and if you think about the recent shootings and knifings on police officers - would you want to take the risk of being shot or knifed if you were doing the job.
YOU REALLY ARE A DOPE PEDALLER !! |

Failing to stop on a bicycle is the same as failing to stop in a car in Ontario. It is an arrestable offence and therefore the police can use whatever force is reasonable to effect their purpose.
Police are trained to ground fleeing/resisting suspect during an arrest in order to handcuff them.
Your civil rights (at least here in Canada) were not violated. |

Yes they are. You know you needed to stop but didn't. By you not stopping it became a chase...It doesn't matter if your on a push bike, a lawnmower or a skateboard.
You have the right to go to court. |

Well obviously the flashing lights and order to pull over wasn't enough of a hint for you to stop.....You were evading arrest or detention and whether you are in a car, on foot or on a bike its called a pursuit and the officers had reasonable cause to grab you and make you stop....You were probably thrown to the ground so that they could cuff you. I think thats reasonable after a pursuit.... Officer safety is a primary concern and the faster they get you secured the faster the situation is safe for all involved. We have family too and dont want to lose our life chasing some pothead who pulls out a gun or knife when we try and cuff them....Tip for the future: Stop breaking the law and cops wont bother you!!!!!.............Deputy Sheriff....22 years |

Yes, the officers had the lawful right to detain you, and can use reasonable force to overcome resistance. This is reasonable force. Stop carrying drugs, stop when the police tell you to. |

So you failed to stop for police which is an arrestable offence
You have some drugs on you and then question the force used to stop you mmm.
Stop next time i thinks is the answer.. The police are not going to put your safety above theres and can use the force required to stop you enjoy the pavement.. |

People talk about De Menezes and other times when the Police have shot a suspect dead. Think what would have happened if he had of been carrying explosives. He had been seen to exit a premises under surveillance for terrorism.
You people are fickle and moan about a 'Police state' then are the first pathetic lot to go running when somebody sent you an unwanted text message. Losers. Also to complain about 'Why aren't they catching terrorists/rapists/murderers?' Maybe if the government gave our Police the capacity/manpower/equipment then maybe they would.
You try having a gun pointed at you, or attacked with a machete. Our Police go through situations everyday that us normal members of the public would not have a clue what to do. You people make me sick. |

Whats the betting that......
you failed to stop
the police used reasonable force to stop you
you became violent
they used reasonable force to detain you.
YOU GOT WHAT YOU DESERVED so stop complaining! |

Sounds like you had a rough deal. Yes they were within their rights to stop and detain you , but if you weren't resisting they were a bit tough on you. Depends on the individual police officer, some are bullies and like to throw their weight around, did you give them any verbal? At the end of the day its their word against yours and the court believe them! If you have injuries take photos and make a complaint. I find its always best to co-operate and be as polite as possible ( through gritted teeth) you have to play them at their own game, being obstructive or giving lip just gets you deeper in the **** ! |

Did they actually ask you to stop before tackling you? If they did and you ignored them then they are probably within the law so long as the force used to subdue you was not excessive. If they did not tell you to stop then they have assaulted you.... |

If you are in the UK and black, what the hell do you expect.
Your just a 'strange fruit' to them!
They take assertiveness training to help them.
Say a wee prayer for Steven Lawrence and his friends. and Damilola, and the Brazilian guy..............and what about the woman in Sevenoaks.that's gone quiet too. |

This is Modern Britain, the police are allowed to do anything...even murder and never be held to account. Just look at the fate of the unfortunate Jean Charles de Menezes - shot seven times in the head, but the police were just "doing their duty". |

Well, the police did over-react, it`s not as if you were going to outrun them.
And the police wonder why they have lost all respect. Apart from the job they do with the anti-terrorist etc, the bobby on the street/car wants to go back to the basics and earn respect, not demand it. |

No they arent allowed to use any violence, unless its serious and someones life is at threat. |

First of all, you should have stopped, but the force they used was excessive to say the least. |
