Better to hit-and-run or pull over if you get into a car accident while intoxicated?

I know what the moral answer is, but I'm wondering which will get you a lighter sentence. I'm trying to settle a bet with my friend.

Pull over so you don't hit anyone/anything else and you should get a lighter sentence since you wouldn't get charged with leaving the scene of an accident.

Cops prefer that you hit and run; cuts down on their paper work, especially if you're at home smoking a phattie while the victim is bleeding to death on the side of the road.

Oh yeah, hit and run, you're looking at the equivalent of a parking ticket.

if you pull over and face the music then you will have less charges and the fine will b a little lower...
if you run then the additional charge of leaving the scene will b added to your list of charges...

a 21 yo here did just that and killed a man and his wife

He will be getting a far worse penalty now for fleeing the scene. They will not be able to prove you were drunk but the jury will assume you were.

In that scenario, pull over, if you want to cut your losses and be able to live with yourself. The police will always go for maximum penalty against a drunk hit-and-run driver.

Pulling over will show the court that you'll be sent to, that you have morals despite your irresponsible behaviour, which the court will take into account. Not stopping, however, is a far more serious offense, and will get you more jail time.

Just pull over and take your punishment. Your first offense for a DUI will usually not result in jail time. You will usually get a fine of average $2,500 and suspended license for an average of 30 days. Thats if you pull over and are completely honest with the police. However; if you run then you will also have an additional charge onto your case "hit and run" "fleaing the scene" etc. If the police go in pursuit of you and you continue to run then you will also have "evading police" and possibly "resisting arrest". It would be best just to pull over an take your punishment for your crime.

The lighter crime would be just to pull over and only have the dui and accident on you, of course you can still be sued in Civil court but the punishment is no where as bad as 10+ years in jail/prison.

Which of the two of you was stupid enough to think you'd get a lighter sentence if you didn't pull-over after getting intoxicated? The running part of hit & run is an additional crime called (in many jurisdictions) "Leaving the scene of an accident".

A lighter sentence would be to pull over - If you hit and run, then you are avoiding the situation and making it much worse.

My bro in law got 3 years for the wreck ,then got 2 more years stacked for failure to render aid.He will be out Dec 2009.My other bro in law got 20 for intoxicated manslaughter,then got 20 more stacked for using a deadly weapon(his car)He will be out around 2030.so good luck with that.

If you get caught you have 2 charges against you. If you don't get caught you have no charges against you. Do you feel lucky?

Morally? Pull over. What if it were you?

Though, as someone who works in the law field. If you were facing trial, there are a great deal of factors one must consider...

Firstly, previous offenses and criminal history. A big enough record will get you locked up no matter what, even if you weren't at fault. I've seen it before. Now... imagine if you're intoxicated. Savvy?

Secondly, evidence. How easy will it be to trace you to the scene? Nearby purchases on a debit card, eye witnesses, debris and wreckage... you'd be surprised the lengths they can and will go.

Lastly, can you even make it? Think about it... if your fender is sticking out of your hood, you're not going to make it far. What better way to go down than stuck about a half mile away from the crime scene?

Like my dad always says... you can beat the rap, but you can't beat the ride.

It's better not to drive while intoxicated but, if you do that stupid thing pull over it is the right thing to do. Better yet what would you the person to do if the shoe was on the other foot.

Well, lemme just say this. I don't have a problem with DUI. I'm actually pretty good at it and you can ask the local Police.

Hit and run always carries a stiffer penalty. It's best just to pull over. Especially if someone is possibly injured due to the accident.

You should not leave the scene. If somebody is dumb enough to drive drunk they need to just take responsibility for it.

Simple.

If you hit someone while intoxicated and leave, they can nail you for hit and run, and fleeing the scene of an accident, and probably some other charges as well.

At least if you stay it would minimize the amount of things you can be charged with.

hit and run charge would be alot worse. Pull over and admit ur mistake and that would look alot better than running away from it....ur most likly gonna get caught either way

A hit and run will get you in serious trouble, whether you are intoxicated or not, especially if you've hurt someone. I mean jail time, not just community service or a fine.

Then on top of the hit and run charge, you will *also* get the charge for driving while intoxicated, which compounds whatever fines you got, and may add to jail time. Sure, you could try to not get caught at all, but if they find you you're in big trouble, and with all the traffic cameras they have now, plus the security cameras from nearby buildings, someone saw what you did.

The latter, even though you will get the punishment that you wouldn't hoping for. If you do the former, then you are in for it, and you'll probalby wish you'd never ran.

If you can get away without being breathe tested at the time,you can always say you did not notice the accident and thought it was a sleeping policeman road hump you had hit,and you had a few drinks when you got home ,if they call on you.THE POLICE HAVE TO PROVE YOU WERE DRUNK AT THE TIME OF THE ACCIDENT AND THEY HAVE TO PROVE YOU MUST HAVE KNOWN YOU HAD AN ACCIDENT,VERY DIFFICULT TO DO WITHOUT WITNESSES

Hit n run, but make sure you reverse over them before leaving the scene. No-one needs a witness either, so run down any that might have seen it happen. If the front of the car gets too damaged, handbrake turn and run them over in reverse. If there is a crowd of people, play bowling with the car as the ball. Try 70mph +

Well if you're simply tryiing to settle a bet and not asking a hypothetical:

Do you get caught for the hit and run? If not, obviously fleeing the scene and not getting caught results in zero penalty.

Assuming you get caught either way? Hit and run when the person dies can end up being a much more severe penalty than a DWI.

But if it's just a fender bender the hit and run is likely less of a penalty.

Weird, huh?
