If someone is arrested, they must remain in custody.
I make every effort to expedite the trip to the station, but there are several things that could go bad with allowing a trip to a public restroom. And I would be responsible for all of them. |

Yes.
If I don't have a female partner, I can't let a female arrestee "go to the bathroom" either in or out of my sight.
I have to take her to the station and find a female Officer or Detention Officer who can take her to the bathroom and keep her in custody. |

Once in my custdoy I don't have to take you or anybody else to go potty. You should have gone before you got on the road. |

She committed a crime and was arrested. She is to be held in custody until the booking is over. Many time the "I gotta pee" is I got to get rid of evidence of another crime (drugs) so I would never let her leave my sight and since I'm not a female she can not go.
I would also charge her for "accidental peeing" in my cruiser as criminal mischief. |

The longest narrative answer on this question reminds me of what we call at the jail a "JAIL HOUSE LAWYER." They have all the answers and not a real clue as to how stupid they sound. But then again...you can usually let their words speak for themselves. |

That's a good question. I was thinking that some people may fake needing to use the bathroom to escape the police at that particular time. I wonder will they that person relieve himself or herself once they get to the police station. I sure hope so. *eek* |

While being arrested, it takes a lot of nerve to even ask to use the bathroom. Some people's kids. Then she wet her pants, boy what a childish act. She had better grow up. This is just one example of how our Police have to deal with all types of people. Even have to clean up human waste, from these low lives. |

yes the cops have every legal right to stop someone from going to the bathroom. She could have done anything in the bathroom, tried to escape, look for a weapon. Once she is in their custody, she stays with them the whole time. Maybe your friend should quit drinking and driving. |

Bathroom breaks are not a requirement of a police officer to give prisoners. Is this a joke question?
Maybe your friend needs to wear diapers if she can't hold her liquor. |

Yes. The officer has the responsibilty of the safety of the person. The only thing on the officer's mind is getting the suspect to jail. |

Where is she going to go? In the road ditch? Public urination is also a crime. Usually if someone wets themselves its because they are drunk. I was stranded on the freaking NJ Turnpike one Christmas for like six hours and had to go like no one's business. Guess what, I didn't wet myself (I held it until I got to a bathroom). If she hadn't been drinking all that cold beer and driving she wouldn't have put herself in that predicament. If she had drank it and kept her tail at home then she could go whenever she wanted to.
There is no law that forbids an officer from making a decision like that. We are in control of traffic stops not drunks.
On an interesting (but unrelated) side note I really hate the NJ Turnpike now. |

I don't know for sure, but I would imagine that it is lawful. They would probably have her wait until she got to the station. NO OFFENSE, but if she hadn't been drinking (I'm assuming that was what the dui was for) she probably could have held it...and she probably wouldn't have been arrested in the first place. It's not the cops' fault. Just doing their jobs. |

While it is kind of a weird situation; the way people are nowadays one cannot blame the police for saying no to someone needing a bathroom. People are very bad nowadays, and females are rarely ladylike. I think the police are forced to be extra careful. |
