California First Speeding Ticket - Should I Fight It?

So I got a speeding ticket about a month ago ... I am not sure how fast I was going, but the cop said they got me on radar at 89 mph.

I then asked him how the process works, trying to lead the conversation into asking for my case to be heard at the county sit(I heard it improves chances of cop not showing up). He told me that since it was my first violation, I will be eligible for traffic school and it will not go on my record. If I want to challenge it in court I will waive my right to traffic school (and will risk getting a point on my record). So I decided not to challenge it.

I just got my ticket today its $400 and my sister was telling me that even if I do go to court it does not mean that I wave my right to traffic school, and that all I have to do is plead guilty and ask for reduction of fine. So I am a little confused.

What do you think is the best thing for me to do? Go to court and try to fight it(and if yes how do I fight it)? And would it mean that I waive my right for traffic school? Should I plead guilty and ask for reduction of fine, or does it make more sense just to pay the fine, do the traffic school and move on?

Your best bet is to contact the courts and ask them these questions. They are the ones who will process your ticket and will know all the laws and regulation. You should also ask the courts if you are allowed to take a driving school class. This will prevent your insurance from going up and points from being placed on your license. Just make sure you get the courts permission before doing so. If you don’t the courts will reject your driving school certificate. Good luck!

Most courts go easy on first-time offenders. My local court has a "No contest" option...basically means you're not pleading guilty or not guilty, but you and the state just come to a settlement. When she saw it was my first offense, she cut the fine in half and I didn't get any points either. I'd see if there's a similar option at your county court.

Going to court does not generally waive your right to school to help with points, but it may ensure it appears on your record. Without knowing what the speed limit was when you were tagged, I can't say which is the better option (huge difference if you were going 89 in a 65 versus a 35 as an example - $400 sounds like a fairly large ticket)..

If you do go to court, you will have the option to negotiate for a lower fine/charge in return for a guilty plea, at which point you can include traffic school in a mix. Generally speaking, first timers can negotiate 1-2 steps down on the penalty chart, tho there is no guarantee of that. It's up to you to determine if that will get you low enough to be worth the risk.
