my friend and i were busted by a undercover cop working on a bigger case but just so happened to stumble upon us smoking weed in my car. To our suprise we werent arrested on the spot but gave our info and were told to call him the next day. When we called He explained he is a detective who was working on a much bigger case and that he didnt have time for us small timers that night but still needed to meet with us in person. For the last week hes been cancelling our meeting or when we go to the PD the lady at the desk sais hes busy. We cant avoid or not call him b/c we are both 18 and snrs in HS trying to keep our parents out of this to avoid trouble. Since He has our info we are afraid to not keep in contact. I know it will be easier to understand once we meet with him but he just keeps cancelling. We know when we meet with him he wants us to help him with finding stuff out at our schoolwith drugs.we are smalltimeand are no use to him. CAN HE CHARGE USAWEEKLATERIFWEDONTHAVEINFOORNAMES

Absolutely. There will be a statute of limitations within which you must be charged with the crime, but it will be on the order of years, not weeks.

You should consult with a qualified attorney posthaste.

make sure not to have weed on you. they can 't really do anything there is no evidence. he is just trying to get you scared so you will do anything he wants. don't give him anything if you value your life. druggies think nothing of human life and would sooner kill you than give you the time of day. stop looking for him, if he really had anything on you he would have found you by now.

Yes,
In Nevada and most states you can be charged uo tp a year after commiting the misdemeanor or felony. (Smoking pot in Nevada is a felony, possessing it is a misdemeanor). He is probably filing charges on you instead of issuing you a citation.

well you can always deny it if both you and your buddy agree on a story and stick to it you will NOT get charged trust me this one time me n a buddy of mine agreed that we did not shoot this kids house and guess what according to the law we didnt so just hope ur buddy has balls to stick it with you.

Yes. Depending on the statute of limitations in your state for that charge, they can wait 1-3 years or more before arresting you.

Unless he can prove specifically who was in posession no. If he actually confiscated some weed then he could charge the owner of the car. No matter what you do do not plea-bargain do not offer statements, remember cops are not your friend. if one of you "gave up the weed" than that person will be charged along with the owner of the vehicle.

Did he keep any evidence? I am sure that he is really busy working on a big case and that he most likely didnt even write it up. If you have not gotten any notice from the DA's office then just forget it. Now next time you decide to be stupid and smoke weed, Don't do it in public and especially not in your car. Don't you know that the police can take your car from you and you won't get it back. What where you thinking. 18yrs old and still can't think. Don't run for any public office please.

If I shoot someone today, and I go an entire year without hearing anything about it, they can still charge me next year. They do not have to arrest you at the moment they discover the crime.

YOUR story, on the other hand, sounds weird. What's to 'talk' about, especially 'in person'? Either he will charge you or not, no matter what you do, and if he was inclined, I'm certain he would already have done so.

As for being recruited to be a narc (is that still the word?), I don't buy into it. What you could be charged with is so minor that it wouldn't be worth the risk. Nor would it net him anything really useful except for some more petty charges.

I know it's easy for me to say when it's YOU on the line, but seriously, I'd wait and let him put up or shut up. Unless there's a lot more that you left out.

I don't know what jurisdiction you are in, but there are some things to think about:

1) Did he give you a citation?
2) Did he take a report?
3) Did he handcuff you or your friend, tell you YOU ARE UNDER ARREST FOR blah, blah, blah?
4) If he didn't do either of those things, more than likely he's not going to file, he just wanted your information for recall purposes, it seems 95% of cops do that.
5) Why did you give your information? Did he ask or you were just being "helpful"?
6) Who scheduled the meeting he keeps cancelling? Maybe he was just trying to see if you and your friend can help with the other case. If you know he wants info regarding your school on drugs and stuff, then why do you suppose he keeps cancelling?

It would be more helpful if we knew the State you are in then maybe someone could help you look up the laws on this for that State?

Also, call a criminal atttorney that offers free consultations and explain what happened. They know the laws regarding this.

nope...he's just messing with you...unless he took the stuff or you signed a guilty plea on the spot (da ) he's probably keeping and eye on you. You might want to rethink thisi "weed" stuff. Besides the fact that it puts your on hold (which in 10 years, trust me, you will notice) BUT it will stunt your growth...and that may get your attention. no you cannot, it is in the bill of rights, the 5th amendment, no double jepordy, which means you can not be charged or taken in for the same crime twice! hope that helped! I really need points for best answer! XD
