Can I be prosecuted or sued civilly for mowing 3 inches into my neighbors yard?

He had an attorney send me a letter for not mowing a straight line. In the past he has mowed and weed wacked my yard and fence and I never cared. But apparently, because I can't mow correctly he wants me prosecuted. I imagine he had the attorney send a letter because he new a cop would laugh at this type of complaint. I suppose a judge will also but maybe I am wrong.

A judge would laugh that out of court and yell at the neighbor for wasting the court's time. Still, I would check with your town/municipality and see if there are any local laws that regulate this.

He can sue you for absolutely anything. Period.

Wether it has any validity, depends on the facts of the case.

I can't imagine any magistrate will be upset with you for 3 inches...

People will sue anyone and anything these days...the case will either be dismissed or you'll pay a $10 fine just to shut him up and make him feel like he won. You should even the line out by cutting 6 inches into his yard! At least the line will be straight!

First he has to prove it was on his property, is there a marked property line ? Personally build a fence

But in general don't answer the attorney, anything you say may be worst than saying nothing. I doubt they really file.

You can be sued for anything, although I don't think this case will go to court. However, it could end up going to a small claims court, and I guess its possible that he could win, but I doubt it, I think judges have better things to do than to care about someone's lawn.

No, this trial will never make it to court. As soon as the judge sees it he will throw out the case. This is a ridiculous reason to sue someone

What would his losses? a few inches off the top of his grass? It would cost him more to sue you then you to reseed the few inches of non-damaged grass.

Technically, he can sue you. As a practical matter, add me the the list of 'no one will take him seriously' responses.

yes he can sue you 3 inches or 3 foot it is his property and he could have had you arrested for trespassing.

I think he wasted his money. I believe a judge would laugh him out of the court room.

I wish my neighbor would mow my yard. :-)

You can be sued. But he will most likely be laughed out of court.

Frankly, I doubt that any attorney would take the time to send a letter. It's probably a fake.

The prosecutor won't waste his time.

Don't worry.

He's a busybody with nothing else to do.

Unless you harmed his grass, he has no cause for court action.

For your own sake, try to be a bit more careful. He might be a nut case.

I thought that sort of stuff happened only in America. Do you remember the Australian woman who politely put her hand on the shoulder of another woman in a Texan movie theatre? The other woman was talking loudly through the film but the poor Aussie lady was escorted out by police and charged with assalt. What a load

Next time you mow your lawn, leave a strip of uncut grass a foot or two wide on your side of the property line.

Send him a bill for $15 dollars and ask him if any of his friends would like the edge of their yard mowed and if so, you'll cut them a good deal!
