I'm a Swedish citizen who moved to USA on Jan 4 this year. Jan 11 I bought a car. Jan 21 I was stopped by the Menlo Park (CA) PD because the registration was expired (I still hadn't gotten the new one in the mail). I still had a valid CA driver's license from 2005 from when I did an internship here which I showed the officer. He asked where I lived and I said I'd stayed at a hotel and currently at a colleague's house while looking for my own place. He proceeded to write me a $25 fix it ticket since the address on the driver's license was not my current address.
My question is if I can contest this. I KNOW it's only $25 but I think the whole thing is silly. I have the time, and I find this interesting :) First of all, can I even contest a fix-it? Second, obviously, I did not notify DMV within 10 days (as specified by vehicle code 14600) when I left USA in 2005 to move back to Sweden. Does this mean I will automatically lose? Or can I claim that even though I lived in Sweden, my US address was still the one on the license? Third, I had been here for more than 10 days without notifying DMV (Jan 4--Jan 21) since I was moving around initially. Can I again claim that the address on the license was as correct/incorrect as any other address I could have put there?

You can contest it but you will lose. Then you'll have court costs on top of your $25. I don't understand the big deal.Just pay the ticket. Why waste time on something you cannot win for a whole $25 especially when it will cost you a lot more than that in time. |

you can always contest any ticket in court but as you have just pointed out you were in the wrong and the officer can always amend the citation to include the previous infraction of having an expired registration. just because you have not received it yet does not mean you can still drive the car. you could also be charged up to $500.00 in court costs. The officer gave you a break by only writing the $25.00 ticket so you should just pay it but that's your choice. |

If you correct the address on your license the judge will probably throw the ticket out. It is a fix it ticket after all. Use your friend's address or where ever you are getting your mail. |
