Okay so I got pulled over in a 50 for doing 65. He let me slide on the speed but got me for obstructed view. I had a cross hanging from my windshield. If I fight this, will I be issued the ticket for going 15 over the speed limit?

I just need to know if he can change the summons from obstructed view to speeding.

He will not 'change' the ticket. An additional ticket will be issued by the officer. You will still be responsible for the obstructed view ticket. You already got a break by not getting the speeding ticket, just pay the fine and move on. |

No, you can't have the speeding charge added on just for objecting to the obstructed view. Once the officer made the decision not to add speeding to the citation then the DA would have to amend it and there is very slim chance of that. The best thing to do is call your county courthouse and inquire as to whether the DA's office has hours for the public to dispute tickets before the court date. If you can do that, then most likely they will allow you to plead guilty to a lesser charge like a city ordinance violation or improper equipment. But do not worry about it being changed to a speeding violation. |

You will probably not get a speeding ticket simply because you fight the other, but you will probably lose the fight on the obstructed view. |

Theoretically, the prosecutor can add the charge. The prosecutor can file a complaint listing all possible charges. In reality, prosecutors don't overrule the cop's decision and will not add the charge if the cop elected not to write the ticket. |

No you can't be issued the ticket you were supposed to get. One has nothing to do with the other. You'll be fine.
Oh and more than likely, the cop didn't write down in his narrative that he stopped you for speeding, but let you slide. As far as the first person who answered, I've never seen that happen when it came to traffic court. |

You would have to be able to prove that the cross was not obstruction your view according to the law's definition of obstruction, not your own. |
