Can I get a dui if I'm driving a little under the influence and some drunk driver rear ends me. Would I still get DUI even if I'm not at fault and the other guy was way drunk?

Absolutely. If you are intoxicated and behind the wheel, even if it was parked, you can be arrested. My husband is a cop and has seen this happen several times. Both parties went to jail. |

If you were operating a motor vehilce on a public roadway and you are intoxicated, yes.... you'll be charged. |

That depends solely on your blood alcohol content. If it's above the legal limit and the cop decides to test you, then yes. If you manage to play it cool so that the cop doesn't suspect anything and you don't get tested, you're OK. Don't risk it. Don't drink and drive. |

If the policy is to breathalyse all parties in an accident then -anyone- in control of any of the vehicles that test over the limit, will be prosecuted. |

There are limits to how much you can drink and drive.
If you are below that limit, then you are "legally sober" and you can't get a DUI.
But he on the other hand WILL, and he might be facing jail as well for a DUI AND reckless driving.
As long as you're sober enough to make the right decisions.
The accident being his fault will also being taken into account by the court. |
