Can I get a fix it ticket even though it's not my car?

My fiance and I were coming home from Vegas this weekend and we got pulled over because of his tinted windows. I was driving the car and assumed since it wasn't my car, I couldn't get the ticket. We thankfully didn't get cited, but when I talked to my dad, who is a traffic motor cop for LAPD he said that the ticket would have been given to me, since I was the driver and the driver is always responsible. I don't think he is right, cuz why would I get a fix it ticket for a car that is not registered to me? What do you guys think? Is my dad right?

Your dad is absolutely right.
YOU are in care, custody and control of the vehicle which was in violation of equipment laws and YOU are the person who will be cited.
You chose to operate the vehicle on a public roadway and you are responsible for all aspects of that operation, including not violating traffic laws, equipment laws or insurance laws. |

I am afraid so. When you took the driving test (for some of us that was years ago) you agreed to make sure that the car was in proper working condition and legal to drive. Once you get in and start it, you are liable for it.

Meg, actually, your dad is 100% correct. The driver is ALWAYS responsible. In your case, tinted windows are an equipment violation. Just because the vehicle you operating was not in your name does not exempt you from any motor vehicle laws. If you let a friend drive your car, they won’t be immune from any equipment violations on your car. So back to your case, you accept responsibility for any motor vehicle you drive on the road, and you also accept and assume responsibility for any contents in your car. For example: Say if you were pulled over and the officer smelled some marijuana odor coming from the vehicle. That will give him probable cause (PC) to search the vehicle. If he finds marijuana, he can charge you with possession, even though it really belongs to the owner of the vehicle. In the future, if you drive anyone’s vehicle, make sure there is nothing illegal in there, because the driver is always charged, as the driver is always responsibility. Now, getting to something a bit more complicated. Suppose you are driving your friend’s car. Your friend is driving. You are the passenger. You are pulled over. The officer finds marijuana under your seat. Even though the driver is always responsible, sometimes the officer can charge the passenger with possession. Suppose the marijuana was found right underneath your seat. Then in that case, the marijuana is in your immediate, reach, care, and custody, thus it’s yours. These are just other scenarios to help you in the future. But anyway, your dad is correct. And I’m very surprised that you came on Yahoo Answers to ask this question. Your dad is a LAPD officer, you should show him more respect than to come on here and ask us to confirm his answer. Don’t insult his intelligence, he’s a LAPD officer - he didn’t get his job easy. |
