Can I have someone arrested for slander?

My Mother is 87 years old...with alzheimers,I have Power of Attorney..I recently had to take control of her finances,because she was giving money away,and was the victim of "scammers".She was very angry with me..
A tenant of mine called my Mother and told my Mother to "go to the bank,take my name of the checking account,and take back her money,as I was going to steal everything out from underneath her.This was overheard by a caretaker who eavesdropped on a conversation.We find the eavesdropping necessary as my Mother gives her personal info over the phone..I have been told that slander is a misdeameanor!!!

No. Slander is a tort. It is not a crime.

You've fallen into the trap of not spelling out the jurisdiction within which you live.

The probability is that with slander/defamation of character YOU would have to sue the alleged slanderer at YOUR expense and prove your case.

Your only chance of getting the police or state to act would be if you could convince them that the person slandering you was attempting to con your mother into handing over her money to HIM.

Slander is a civil matter not a criminal one. Ignore gossip and move on. Slander only becomes liabel if it has cost you your job or some other financial problem, or if it causes you a loss in any way,which you must prove.It is still not a police matter.Why allow an old bags gossip bother you if there is nothing to worry about. It is no ones business so how did the gossip crow know of the financial arrangements.Maybe there is more backstabbing going on inside your home than you think.

In Canada slander is not a criminal offence, you could however sue someone in civil court for defamation. I'm not sure that the statement would qualify though, even for slander. You need to talk to a lawyer that specializes in civil litigation.

While you could file a complaint with the police, it is a hard one to prove. I know that sounds unfair. You said that the person is a tenant of yours, maybe a better thing would be to send a letter to the person. Tell them that this has upset your Mother and she has enough problems without someone upsetting her. Also, you may say that any further calls like this will result in legal action. Message should be received.

As far as I know, you can charge some one with Slander, but there needs to be some sort of documentation to back up your charges.

You need to talk to the district attorney in your area. Discuss possible elder abuse, fraud, larceny, identity theft, etc. against your mother.

First, are you sure that the person that came back and told you this information is sure what she heard? I doubt that anyone who would say that would tell someone that with others around! If you are certain of your source,
THAT TENANT WOULD GET 30 DAYS NOTICE TO VACATE if she were renting property from me and I would tell her exactly why.


I would tell her that since I am such a thief you could not possibly want to continue to rent from me and since I find your character attacks quite painful, it would be best for you to meddle in the affairs of someone else from SOMEPLACE ELSE!

SOrry to say that I dont think that this statement could have the tenant arrested.
It is not a misdemeanor but a matter that would be handled in civil court!
I actually don't even think that you could win a civil case against her as you would have to prove that you are somehow damaged by this statement.
Unfortunately, if your mother would have taken your name off of everything, you would still have a hard time proving how this damaged you (her yes, you no)

You'd probably have a hard time with that, as it could be interpreted as an opinion of what you were going to do. Now, if she had told another person that you HAD stolen your mother's money, that might be a different story.

No, slander is a civil wrong, not criminal. People can be arrested only for criminal wrongs.

I thought slander was a civil matter not a criminal one. If you can prove that this caused you damages you can sue in small claims court.

Slander is very hard to prove. Firstly you must prove that the person said it with the intention of ruining your good name. And secondly, you must prove that you did indeed suffer financially or mentally and the such.
