The law allows you to apply force needed that is necessary in your protection. If you were being raped and killed someone and could prove you were being raped and were in fear of immediate deadly harm, ( which is possible because a rapist can kill you ) you would not be charged.
However, if the rapist was running away and you then got a gun and shot him dead, you would have a problem, Because you would not be in immediate fear of harm or death, he is running away. |

There is no way for anyone to answer this as laws differ from state to state and interpretation of the law is different from state to state. You can be charged with anything. Most police officers would commend you and pat you on the back and most prosecutors would secretly commend you. How they respond though can be vague. In most states, you do what you have to do to protect yourself. If someone is trying to rape you and you snap their neck so be it. There is the rare occasion when the prosecution gets a bug up their butt and tries to make it sound like you were excessive. My point is, who gives a sh**?! If you try to rape me and I don't kill you while you are trying to do it, you'll be lucky I don't hunt you down and kill you later. |

Make sure it looks like you were the victim of rape BEFORE you decide to kill someone. You know, rip some clothes, a little blood here and there, a struggle; these things help law enforcement officers about whether it was self-defense, justifiable homicide, manslaughter or murder. I think legally you would be allowed to. I don't think it would be right, and it would burden your conscience, but I don't think you would get punished. At least not in this world. |

chances are if someone is raping you they are bigger then you and you couldnt just "snap their neck" but given u had the opportunity you could defend yourself in most states however you couldnt just go kill him 4 yrs later and call it self defense |

It can depend a lot on where you are, which is kind of stupid. I would have a hard time killing someone with my bare hands, but I use this stun gun thingy that looks like a cell phone. My boyfriend got it for me from http://www.mhodefenseproducts.com/cellphonestungun.htm. I haven't used it, but I do like having it with me! And it doesn't kill, so I don't have to worry about being stupid laws. |
