Last night a crazy chick came out of no where and slapped me across the face. She was screaming at me in Spanish which I suspect was threats for more bodily harm. I have no physical injury, but want to sue her for damages. I don't want to press charges though because she is crazy and fear when she is released from jail she will come after me. I figured I can get a restraining order on her and sue her in small claims for the max of $2500, but is this enough to send her a message.
The backdrop story is she has a major crush on a friend of mine and was stocking him last night and saw me come out of his house and became infuriated. about a year ago, I was renting a room from said friend and she came into his house when I was the only one there and came to my room, banged on my door till I openned it and demanded answers to her questions about my friendship with this guy. She was infuriated and I felt that she was going to attack me so I showed her with my stance that I wasn't intimidated and offered her info to appease her and calm her down. But it freaked me out and I told my friend that he should get a restraining order out on her, but she of course denied it and I had no witnesses. But last night I was at my car with another friend and she came up between us and slapped me across the face. So obviously she never learned her lesson and has now crossed the line. I want to get her thrown in jail for assault, but I fear this crazy, uneducated, delusional woman will come after me either directly or through some low-life she knows.
And if I sue for assault can I do it in small claims court and if yes, can I do it without involving the police?
I need unbiased opinions here and any legal advice please.

Get a lawyer. Yes you can sue w/o the police. BUT, your lawyer will tell you that it will be better to file a complaint with the police. It will show that you made an effort to getting this solved/corrected. Going by your info, you have several charges that you could bring against her. Believe me we she startes having to pay money for her actions against you in court fines your message will be loud and clear. You could always do both. Never let anyone intimidate you so bad that your constantly looking over your shoulder. Make a stand and use the law to your advantage. |

The only recourse you have is to press charges, to sue for damages it will be all in vain, she will have a lifetime conviction of stupidity, continue with a restraining order.
