My apartment has a drive way that wraps around the back and a small parking spot along it...the other day I was parked in the spot for approx. 2 hours. When I returned to my vehicle there was a note that says " a report has been filed this is a fire lane and your vehicle will be towed." The issue is there are no posted signs for no parking, tow away zone, or fire lane. the note was hand written on a small little piece of paper. Can they legally tow me in this case? Everything I have read says fire zone must be designated by the fire dept and have clearly posted signs. As well a tow at owners expense sign must be posted or I must be clearly blocking an entrance. Whats your take on this....am I in the wrong, if they do tow me can I defend my right to park there?

Since it is private property, 'defending your right to park there' is probably a lost cause. At best, you would force them to post proper signage.
With respect to whether or not a tow from that location is legal, your best bet is to actually call your local police department and ask them about local tow regulations. You should also keep in mind that private party tows can be done for things that are not covered in the vehicle code - for instance, if you have assigned parking and someone parks in an assigned spot, a property owner (or manager) can tow a car away out of that spot even though it is 'legally' parked. There may be something in your lease/rental agreement that permits a similar tow from the location you parked in.
In some instances, however, you are correct; proper signage and/or curb markings must be in place for some types of tows. It is possible you could recover the cost if your vehicle was towed in such a situation, but it's a gamble not worth taking. |

Are you sure it wasn't a prank because it does have to be posted the only thing i can think of is if there is a red curb or a red line designating a fire lane but if not and your car wasn't towed it was a prank if it does get towed in the future speak immediately to the people that run your apartments and straightentn them up
