Yes, actually. If you are drunk (as I am assuming) and you state the intent to drive and actually get behind the wheel, the cop can arrest you. Cops can arrest you for walking down the street, doing nothing wrong. True, you will be let out 24 hours later without being charged with anything, but don't think the cop will even be censured for arresting you because he was in a bad mood and didn't like your looks. |

If you then got in the car and put the key in the ignition, yes. Most cops would stop you from driving, but the cop is under no obligation to stop you from committing the crime. BTW, in some states it is against the law to be drunk while near a car. |

This is actually a very common ocurrance. What happens is that people leave their car keys inside. Some police officers may assist you in opening the car or they may call a lock smith for you.
This happens more frequently in small towns where not much action happens. These type of activity get publisized in the local newspaper.
Remember that an officer of the law will only arrest you if you are breaking the law. There is no law against breaking into your own car. If its your you can pretty much do what ever you want to it as long as it doesn't violate other laws. For example, setting your car on fire will probably violate some fire law ordinance. Plus it will littered the street. Breaking your car window may be considered loitering but if its in your own property then who cares. There are exceptions too like you need to break the window in an emergency. I think as long as you clean it up. If its not your car whos window you are breaking then is vandalsm and then you willget into trouble.
The only way I can see problems when breaking into your own car if is there is a confusion as to whom the car belongs to. For example a "good" citizen sees that you are breaking into a car and say person calls the cop. The cop ten goes investigate and accesses the cituation. If you where cought inside the car and you cannot prove that it is your car then I can see how you may get into trouble. But, in the end once yu provide some proof you will be ok. Fr example, I got a ticket and I did not have proof of insurance. I receive a second ticket for that but, the officer gave me 10 to 15 days to provide the evidence. I did so the second ticket was taken away. Remember that now everything goes on record so is very easy to track you and get a hold of you.
Opps I did not read the drunken part. Well, I don't know what the laws say about being intoxicated in public. The thing is that you cannot drive under the influence of any substance wheter is Jack Daniels or nyquil. You can ask the officer but he will not open the car for you. If he is real nice he may call a cab for you but you will not drive away. Because you did not move the car there is no moving violation therefore you should not get a DUI. Again, I don't know the law about being drunk on the street. There might be some ordinace about that in which you may get into trouble. If you blew a 0.41 that means you would be dead or well on your way. AT tat point I would had called an ambulance. 0.10 is extremely drunk. 0.41 means that almost half your blood is alcohol. So, I think you typed your number wrong or I read wrong. Maybe you meant a 0.04 meaning 4% not 40%. I think in that case the officer would still not let you drive. I mean if he asked you to take breath test then you must had showned it. I think you would just get harrassed a bit. |
