if he dosent ask you for you registration or proof of insurace? And there are a number of mistakes on the ticket, they told us he was going 45, but they wrote 48, the date is wrong and the place he supposedly was speeding was wrong too, what are the chances of us winning if we fought it? They also got the time wrong by one hour.

having delt with cops in arkansas all my life i can say it sounds like you ran into a speed trap.
if there is even one mistake on a ticket, your chances of getting it tossed in court are very very good. the police here tend to hope you will just want to avoid missing work and pay the thing. |

Yes they can, if you were speeding you were speeding, insurance or registration has nothing to do with it. |

You don't state what the speed limit actually was, however, if the ticket was written for an amount over the speed limit...speeding is speeding in the eyes of the court. An exception would be "aggrevated speeding" where the driver exceeded 25mph over the limit...then there may be an arguement before the court.
The registration and proof of insurance are not the reason for the initial stop therefore not absolutely necessary to check...however...I would have checked!!
I would appear in court and argue my case before the court that there are inconsistancies with the actual ticket! Your arguement would be that there also may be some inconsistancies with the officer as well. In other words...is there a reasonable doubt in the courts mind about the validity of the offense.
The court will then decide who to believe. |

what county were you in? some lawmen here in Arkansas are real dumb***es. Even if things are wrong on the ticket and you can prove it, it is still your word against the cop's. |

Yes a cop can give you a ticket.
Not asking for registration and proof of insurance does not invalidate the ticket.
It does not matter what he told you, it matters what is written on the ticket.
The rest are clerical errors and can be corrected in court. |

Your chances of getting out of it are 0! He does not have to ask those things! save yourself time and trouble and just pay the ticket! You should have read the ticket to look for mistakes before you signed it! |

Was the ticket signed by the offender at the time he was issued the ticket?
If so, he was acknowledging that the information filled in on the ticket was correct. It's going to be difficult to prove otherwise at this point. |

Depends on what he gave you the ticket for. If it is for speeding, he does not need the proof of insurance- although if he askes and you cannot produce a copy of it, you can get a ticket for that too. What you can do in this case is go to court and request a hearing, then explain the whole situation. Good chances are that the cop won't even show up and you will win. |
