Basically, I was traveling through California to get home to Oregon. I was following someone from Washington. Aside from the fact that the officer pulled us over in a 65MPH zone claiming we were speeding in the 55MPH zone earlier (which he was never in because he was traveling South while we were traveling North) but I was following the person in front of me very closely. The cop cited me for going 62 in a 55 and the other person in front of me a 66. The driver of the other car flagged me down and said the cop had stated he had him on radar at 66. The cop told me he had me on radar at 62. I was under the impression that once you locked into a speed you cannot reset to get the speed of another vehicle, especially if they are traveling back to back (within 15 feet of each other). Help me out with this? Thanks.

The story you offered here indicates a cop did, so evidently a cop can.

Yes, radar units are disposable...good for one use only, and cannot be reset once they lock onto a vehicle.
And seriously...walk into court and explain to the judge that you were driving 15 feet behind another vehicle at no less than 55 miles an hour. That will absolutely prove you are not guilty of speeding. |

Interesting that he was able to pull both of you over for a speeding violation at the same time...but generally, if you stated that you were following the other driver, and YOU were the one to be cited, it could probably be ascertained that you were following at a high rate of speed in order to keep up with the other driver, who in this case was implicated by you to be speeding...because you were following them in convoy. If they had continued to drive on as you were pulled over, and you had not mentioned you were following them, they probably wouldn't have been cited. I'm not an attorney or an LEO, but this is just my stab at it...Its possible you could fight this in court. |
