they'd been going to my girlfriends house every friday now for the past 3 weeks, but this time they just went and knocked the door and asked for me like always and then, they just pushed my girl friend's dad and trying to get in the house, without showing any search warrant of some type, so they just let them search the house, but could they push him because he kept saying i wasnt there and i wasnt. Additional Details look you guys, they never showed the warrant, plus you need a search warrant to go inside the house, plus all they did was ask for me and then they were pushing him out of the way. so no idiot answers!!

an arrest warrant and a search warrant to different things. Now on your arrest warrant if it was your house and they had knowledge you where their they can enter on the arrest warrant.
if you are at your in-laws house and all they have is an arrest warrant for you no search warrant they can not just bar in unless at the door when they ask if they can enter and they see you called plain view then they can proceeded to arrest you by entering the house, the other way is to wait outside if they think you are in the house and get a search warrant for the house not hard with the right judge |

When the police have a warrent for your arrest and go to residence they have to show the warrent and ask to search the house. Your girlfriends father should contact an attorney, alot of them will do a consultation for free. You should just turn yourself in so it won't happen again, I hate to say that but its better than being arrested on the streets or in your girlfriends house |

At any rate, you stated it yourself "So they just let them search the house." End of discussion. PD will keep going there because they obviously suspect a link between you and that house so no, it's not going to stop.
If her father is trying to obstruct justice by hiding you he can be charged. Oh and hey, you EVER show up there and the PD can prove it, like oh I dunno, watching the house and getting pics...that stuff called surveillance...he and your girlfriend can be charged with harboring a fugitive.
You don't want to accept responsibility for your actions, be it 1 warrant or 1000, fine but to put people that care about you at risk?
After this, I'd hope her dad would tell you to get the hell out of her life because you aren't man enough to be in it and certainly aren't worth going to jail for.
You've made all kinds of excuses in your head about why you are perfectly right about breaking the law and continuing to do so but how the hell do you justify pulling innocent people into your crap. disrupting their lives? Or do you just not give a damm about anyone but yourself? |

if that's not were you live they shouldn't do that. they supposed to show him the warrant saying that it was OK to search his house. that's only if you live there other than that, this police officer were really abusive to the guy. |

Frankly, if you have an arrest warrant, then you did something wrong. I think they should of not only pushed him out of the way but grabbed you pushed you all the way to the police station. Thank you so much for taking advantage of the system. Now go to jail where you belong. I'm sure everything they did was legal. And I very much hope you get to be in prision for a very long time. |

Dude, if there is a warrant for your arrest, turn yourself in!!! You're obviously making it a living hell for other people. And it's only gonna get worse if they know that you are wanted and are hiding. Besides, it must be pretty serious if they keep going to the same place, someone is obviously on to you... turn yourself in and get it overwith... it may just be parking tickets or whatever... don't let others suffer for your mistakes... |

Yes they can, but the question you should be asking is, Why are you putting your GF's dad and her through this? if it was my daughter I would have taken your butt to jail myself, and told you to stay the hell away from her. It's all your fault, so you should take care of this yourself and stop getting everyone else involved in YOUR troubles.

it is all based on probable cause. if they had the search warrant, yes, they can search the property. if her father would not let them in he could be charged with obstructing justice. law enforcement has the right to "Knock and enter". all they have to do is state that they have a search warrant and then enter. their first priority is to secure the dwelling to protect themselves and others in the home. after the home is secure, then they must present the search warrant.
they must have reason to beleive that you are in the house. by either witnessing you enter or persuing you into the house.
if they do not have probable cause that you are there, if they used excessive force, or they did not have a search warrant, then they have violated your 4th ammendment rights (search and seizure)
All that said, if you have a warrant for your arrest, i highly suggest that you turn yourself in. No matter where you go, it will be waiting for you. Any judge will go lighter on you if you voluntarilly turn yourself in rather than being a fugitive.
Turn yourself in and then work out the other legal issues with the 4th ammendment rights of your girlfriend. |
