My friends brother is 22 and he has been dating a girl since she was 17. He wants to break up with her because she hits him and gets mad and breaks his stuff, and way more than that, but she threatens to charge him with statutory rape, EVERYTIME. She is over 18 now. If he marries her and then divorces her, can he still be charged with statutory rape?

we are in California and she just turned 18. Her mom is on anti-psychotics and she used her situation to persuade him to let her move in with him and her mom gave verbal consent.

i'm not sure if this law applies in california but the new law, at least in GA, is that even if someone is under the age of consent if the two are 3 or less years apart the law does not apply, |

It depends on the laws of the state they are in and how long ago she turned 18. There is a statute of limitations, meaning there is a certain amount of time that he can be charged with the crime. I'm sure he will be much safer if he just leaves. He could also call the cops next time she abuses him. He may feel silly or less manly calling the cops but there at least will be a report of domestic abuse on her part. |
