It was probably legal, but it stupid of him to do so without another officer present. The fact that he didn't call one over is suspect. Don't know what you could do about it, though. Be careful about having anyone in the car with booze breath, though, or else state that you are the designated driver. |

A female officer can frisk and male suspect. Likewise, a male officer can frisk a female.
The point most are not aware of is that the frisk conducted by officers of the opposite gender should normally do what is known as a "simple frisk."
This means a general "pat down" to insure there are no weapons that will endanger the life of the officer.
For a more thorough search, an officer of the same gender as the offender should be called in.
Wearing a mini-skirt is a mute topic unless the officer did less than a professional search.
While I'm thinking about it...there is one response here telling you the search was entirely illegal...always consider the source of the information you receive. |

Of course a cop can frisk you for weapons for his/her own safety. For all the cop knew you had a gun or knife on you. |

It’s legal, and it was probably filmed on his dash camera to insure no liability issues.
Most male officer I know hate searching females (me included), strangely most female officer I know don’t mind search the guys (or at least they act like they don’t).
The frisk when done by a male on a female is tricky, my state rules are specific on how it is conducted, contact in “sensitive areas” are done with the back of the hand and do not include contact with bare skin (obviously no weapon hidden on bare skin). It is more intrusive than I am comfortable with and thankfully there is usually a female officer handy (who frisk females much more aggressively than male officers do). |

This was illegal. In order to stay within the law, he should have called for a female officer to frisk you. He did have the right to keep you at that location until the female officer arrived. You should take legal action against this. Cops abuse their power sometimes and get away with it because people do not know their rights.
Edit to add: After so much opposition I researched and found out that I was wrong. I took a criminal justice class in high school where I was taught the information I stated above. I was taught wrong. I wonder what other things I was misinformed about. |
