Can a mother report her child as missing/runaway if she gave her permission to move out?

My niece(will be 18 in 3 month's) was given permission BY HER MOTHER to move out last Jan. On the 5th of April she reported her as a runaway/missing child. There has been nothing but animosity between them for a long time and a lot of physical abuse that has been reported but nothing is ever done to the mother. It had gotten so bad after she sent my niece to JD several times, she told her she could move out. Here is the kicker: She still wanted TOTAL CONTROL of my niece even tho someone else has been supporting her in every way, And she lives in another county! The mother still receives hud, tanf and foodstamps on my niece and has all along even tho she is no longer at home! The only reason she reported her as a runaway was because she was told that not all of her 20 phone calls a day could be answered.BTW: This mother also has guardianship of her grandchildren who have been infested with lice for many many months, been without food(after receiving $700.00 + in foodstamps.Is this legal

Another note: Her mother let her move all of her belongings out.The only thing she left behind was her bed and dresser because the person she moved in with didn't have room for it. How can a report like this be legal?

Her mother can not give her permission to do something illegal. Emancipation must go through the courts.

This mistreatment should have been reported when it first happened, not after the mother decided to report her.

**I see, must be so frustrating when the agencies won't do what they should. Perhaps you can send this story to the news anonymously? Sounds silly I know, but we all have heard of bad things happening because the agencies are too late to respond. At least you are trying..

The mother knows the system. She reported her daughter as missing so that she still can rip of the Government and collect money for her. By reporting her as missing, she might not be responsible for her daughter's doing. Your niece is almost 18 and if you want to report the mother to the Child Protective Services, than do it now, before it's to late.

Bottom line is this. When she reports these things someone should go behind her and let it be known that there has been reports of abusive treatment made several of time. Not to mention the fact she has given her permission to leave and why now? Mention the fact here it is several of months later and she is still controlling and reaping all the benefits as if the daughter still lives in the home with her.

Why she wait months later to file a missing report etc..
If you have your niece best interest in heart somebody (including you) needs to step up to the plate on her behalf.

well in the state i live in it is legal to move out at 17 , but if the mom told her to go she can get in trouble to child Abandonment (if in your state you have to be 18 to move out)

your niece needs to tell the JD counsiler instead of acting a crazy person...but once she is 18 she can just go ,and there is nuthing anybody can do..

The mother is committing fraud.
She has no business reporting a runaway when she knows that the child moved out. She is abusing the system and deserves to be jailed and forced to repay the amounts that she has obtained illegally.

If your niece is almost 18 and her mom treats her like that, legally her mom can't do anything. As far as the grandkids are concerned, they need t be taken away from her and placed somewhere else where they can get fed and get rid of the lice. I would report to the dept. of Human services that your niece no longer lives there and get her removed from the tanf and foodstamps.

If im honest im not 100% about the first part. So ill answer on the second part. Grandchildren infested with lice - i would say yes, that is child cruelty, especialy if she knows. Those children are probly itching and months and months can casue serious damage to the scalp, and the lack of food is certainly child abuse. Family or not i would , talk to her..if she doesnt see a problem report it, if she does and"says" she will do something, keep your eye open on changes, if none are taken, i would report her , regardless of who they are.

No, she gave permission. Now she wants to lie and say she is missing. NO! That is exactly why we need to think before we speak. She could be in trouble for the Gov. substances she still receives.

I'm appauled by all the incorrect answers on here.

The FACT is that the mother is the girls legal guardian until shes 18 years old OR the girl gets emancipated from her mother.

The mother giving verbal permission is not a legal agreement. The mother has the authority under the law to report her daughter missing.

If the girl wants a legal way out she needs to apply for emancipation from her mother.

Yes, Because you can't tell your child to do anything illegal. Its like saying "jump off that bridge". They can report it after 24hrs. (at least in Minnesota). But if the child was to go to court with her mother and explain her cituation he/she could got amanstapaded. (not sure how to spell it) and thats where the child proves she can live on her own. sometimes u need things like a job and car to prove u can live on ur own.

Where do you live? Report the mother to DEFACS and if they don't respond go to the police....for the GRANDCHILDREN SAKE!

Your niece should contact the courts and see what she needs to do to immancipate her self from her mom and see if it can be done ASAP. Or she can just wait the 3 months out and then legally move out.

Also, some states consider 17 as adults in the legal world.

No. Missing or runaway means they ran away and are MISSING as in the person who has custody of them has no clue where they are and believes they may be in danger.

I think the mother cannot give her permission legally if she is a minor irregardless.

Her mother can be put in jail. My mom did the same thing to me. And the police came and got me. But my uncle told them it was her fault. She is a bad mom. Shame onher.
