Okay, me and my fiance got in a fight.
and i made the mistake of calling the police.
they completely over reacted, tossed him in jail, and charged him with four different types of abuse.
i don't agree with the charges, and they were against me?
so i really dont think they should be able to charge him for something, even i dont think happened.
they made me give a video statement against him and all this nonsense, the night it happened when i was all upset and angry =/
seriously, i feel no threat against him whatsoever, and i called a few people and some told me it could be lifted, others told me it couldnt =/

When you phoned the police, they had to assume that you were in danger. If they have probable cause to believe that the violent crime was committed they do not have to base that on what you say. Many battered women will refuse press charges, therefore, the police in many states were empowered to act on probable cause to protect them. Your decision to phone the police (as a lesson to him, punishment, game play or whatever) has now caused REAL harm and you want to back away from it because it is not what you wanted.

Sounds like he's charged with DV (Domestic Violence.) The state brings the charges, not the person. He's screwed. He'll probably do some time in county jail and have to pay a fine. Are you going to call the cops on him again?
If he abuses you, then get out of the relationship while you can.
If you made up a story against your fiance because you were mad at him, then you commited the crime of filing a false police report in which case you will do some jail time and pay some fines.

It can only be lifted by the judge that signed the order. You'd need to go before a judge and request that the no contact order be lifted. |
