that person is pretty much on their way to prison, the best they could hope for would be a year in the county jail and then like 5 years probation but kinda doubt that will happen Do the Crime you Do the Time!

That depends on his lawyer and some other factors like what was stolen, how much violence, time of day and even location. A crime in a public place is always treated harsher than in an isolated place.

It's possible they could just get probation and have the charge lessened to a misdemenor, but that depends on the situation, ie what they stole, ect.

Depends on the judge and what he stole.

Most of the time a deal will be made and they will be able to get away with probabtion and a six month program or something. Jail is always a possibility though, first offense or not.

Theft is a crime. Grand theft is a felony. The definition of the crime and the allowable sentences vary with each state and country, but the general definition of a felony is any crime punishable by more than one year in prison. In my state, the maximum penalty for grand theft is ten years in prison. That is unlikely for a first offense, and I could not guess what sentence is likely without even knowing what state or country you are in, along with a hundred other details.

A person most certainly could, however, the law sets limits or sentencing guidelines judges usually follow- I think its anything from probation to prison- but:

The great thing this person has going for them is the no priors. If you have no prior history you have a much better chance of getting probation. (But you better not let it happen again)

If the theft was commited in order to get money for drugs, the person could own up to that and ask for drug diversion (treatment) instead of jail time.

I think it will also matter where this occured. Large cities have over-crowding problems in the jails and the judges are much more likely to let the person off.

Small towns especially in the deep south can be the opposite. A person could get a 'hanging judge' and get the book thrown at them and wind up in the penitentiary.

The first thing that should be done is to try to get the DA to aggree to a plea deal where the person pleads guilty if its reduced to a misdemeanor. Thats really reaching but has to be at least tried- the felony will be on that person's record the rest of there life- thats worse than any initail jail time will be.
