Can a police officer?

pull someone over when they run the plates on the car and see that the person the car is registered too doesnt have a valid drivers license? I wasn't speeding or doing anything wrong and it was my brothers car and he doesnt have his license. I need to know because i got a ticket for no insurance on the vehicle. please help?

no cannot do it before you or anyone can be stopped there has to be probable cause not just a suspicion that the person who may be driving "might" not have a valid drivers license

If you are driving with no insurance than it doesn't matter who the car belongs to.They will ticket you anyway.Sorry to hear about it.Good luck.

Generally, that would be sufficient grounds for reasonable suspicion that a crime (driving without a license) was being committed.

You are trying to dispute the validity of getting the ticket I'm assuming. Well, the ticket for no insurance on the vehicle is legit, unless you yourself has a coverage that allows you coverage on any vehicle you personally drive that is not your, like a rental.. the pulling you over part is "just cause"...did he have just cause...police officers normally will run plates on vehicles when they see something unusual, like driving too slow, or erratic lane changes...but to just randomly run plates for no apparent reason..highly unlikely.

Yes he can. You were driving a car on public property and the officer caught you there. If your brother has insurance you can get the ticket taken away. If I were you I would make him pay you for the ticket.

If the car wasn't inured you are screwed, don't ever drive an uninsured vehicle.

The police can stop you just to get your identification. What they find after that is all something you are liable for.

Regardless of why you were pulled over, you didn't have insurance on the vehicle.

What's your point?

Probable cause is very liberal. A police officer can "pull you over" for a variety of reasons. Even if they simply want to do a "safety inspection" on the vehicle. Obviously you did something that garnered the fine officer's attention. You were given a citation because you are in violation of the law requiring insurance.

your screwed. most states it's a $500 fine plus court cost. then you include missing a days work to go to court. if your brother gets insurance on the car before you go to court you may have a chance. something he needs to do anyway

yes they can. my fiance had this done to him. but he got much worse done to him for it. they made up an excuse about the window tint. im not 100% positive, u might want to see a lawyer but they did it to us and im sure they have done it to many others. Hope i helped :) Me

yes, they can. They wanted to make sure that the person driving had a license. What's so bad about that?

Better question: why are you driving without insurance? I don't have any sympathy for you because it is accidents by uninsured motorists that help drive insurance rates and fees through the roof.

Most all of these answers are making excuses because they broke the law in a similar fashion and won't accept the responsibility for their own actions either. You did nothing wrong except not making sure that you or your brother had insurance when you drove his car. This is explained when anyone gets a drivers license for the first time and so you cannot plead ignorance of the law. Ignorance of the law (had this not been explained) is not a defense. You are guilty of driving without insurance. If you go to court and explain this to the judge in a reasonable and rational manner, and have no other "offenses" he may give you a break. However - had you had an accident and someone was hurt - this is a very serious offense. Mail the fine before the due date and obey the law in the future. No more excuses.

Unfortunately, you were driving a vehicle that wasn't insured. That's about all they can stick on you. Just because your brother owns the car and doesn't have a valid license doesn't make a bit of difference. If you had a valid license when pulled over, the only thing you will get charged for is operating a motor vehicle without insurance. If this is the first time, you will just have to pay a fine. However, in most states now, if you get caught without insurance a second time, then you can go to jail and lose your license. Good luck!

THEY CAN NOT PULL YOU OVER WITHOUT PROBABLE CAUSE, HOWEVER THIS WILL TAKE A LAWYER TO PROVE IT IN A COURT OF LAW. IS IT WORTH HIRING A LAWYER? MAKE YOUR BROTHER PAY THE TICKET, THAT IS THE CHEAPEST SOLUTION. IF YOU GO BY YOURSELF TO COURT AND TRY TO PROVE IT THE OFFICER WILL MAKE A EXCUSE FOR PULLING YOU OVER SO IF YOUR GONA FIGHT BRING A LAWYER.

The police can do whatever they want to. Here in nashville The king pig serpas had a DUI checkpoint, They issued over 68 Tickets at just 1 checkpoint. No body was moving so it couldn't have been for speeding. Only 1 of the tickets was for a open container.
