bottom line is, you had tinted windows that were darker than what was legal, and he spotted it, stopped you for it, and you got a ticket.
Professional window tinters will take this into consideration when tinting windows, and many won't apply tint that is considered illegal.
Many "riff raff"-type people will stay away from tint too dark because it does give police a reason to stop their car. |

It is probably dependent on your local laws regarding window tint. In our city, if you cannot see the driver thru the window tint, the tint is illegal. One of the reasons the law is there is to protect our police officers during traffic stops. |

What he had was reasonable grounds to pull you over. Speculation has no part in the decision to pull someone over. Reasonable grounds to feel you committed an offense. Probable cause is stronger than reasonable grounds. Either can lead to the officer writing a traffic ticket or arresting an offender.
In this case, the reasonable grounds was tinted windows. The probable cause for the ticket was his test of your window tint. |

He could tell by looking at your vehicle that your windows were too dark, that's all he needed to stop you. Apparently there is a law or ordinance in your area that specifically addreses this. Sorry, you'll have to get your tint removed and replace it with lighter tint. |

It is not speculation, it is reasonable suspicion. Seeing a window that is tinted too dark an officer can do a traffic stop. I have done many with tinted windows. The only time I gave a citation was when I had a tint meter with me. If the officer states he was unable to see through the window at all he would not need to know the exact tint, as that would be enough for a citation.
Having windows tinted is one of my favorite traffic stops. Whenever I had down time I would make traffic stops. If I saw a violation from two cars I would take the one with the tinted windows every time.
Where you work has nothing to do with getting a citation or being stopped. |

A police officer can pull you over if he has a reasonable suspicion that the tinting on your windows violate state law. If after pulling you over, he determines there is probable cause to believe your window tinting violates state law he can issue a citation. It seems like his "test" established probable cause. A local shop that regularly tints windows should be very familiar with the laws of the state you live in. Perhaps he can "fix" your tint. |

No, he doesn't need more than speculation to initiate the stop. If he had suspected you of driving drunk because you were swerving around in your lane -- and he can pull you over for that --, then he has the same right to pull you over if he suspects your windows are too dark. Darker tints hide things from the people outside the car. Usually illegal things. That's why they are not allowed, plus it has saved more cops from being shot from behind tinted windows. |

It can be contested, if your up to it. Usaully does not require an attorney as this is a traffic violation. However, be aware that you have become moving target. Been there done that. |

No he doesn't. It's his perogative to pull you over for any violation that he suspects or sees outright. Window tint violation is completely ridiculous, of course, but it is a legal point. I'm afraid you're screwed on this one. Just don't fight it....pay it and get it out of the way before it compounds.

In most cases yes. An officer is allowed to depend on his/her experiences. Most good traffic officers can estimate the speed of a vehicle within 2-4 MPH. Thus any officer that has seen enough tinted windows can use this to base the stop on. The old adage " if it walks like a duck...." well you get the drift. |
