We were involved in a small claim law suit (my wife and I ) we lost but had not been notified by mail at the time the plaintiff starting calling and demanding us to contact her , which rules in missouri state you should give 10 days before contacting the other party . she told me to call her back , so I did and was really ugly and threatened her if she called again , she filled charges on me for a class A misdemeanor and a restraining order trying to cause problems , but I only made 1 call which she did tell me she was expecting my call , when she left her message , I live in Kansas and she lives in Missouri , now the sheriff is demanding I come to that state and pick up a summons to appear in there court to answer to the charges . can they do this do they have jurisdiction ?

Yes you can be charged. If you fail to take care of this it can turn into a warrant for your arrest and be placed on the NCIC computer. If you get stopped on traffic or the police have any reason to run your driver's license or name and date of birth and the warrant shows up. You could possibly be taken into custody and extradited to Missouri if they want to confirm the warrant. |

Do not go. You live in Kansas therefore Missouri misdemeanors have no power over you. Ignore those phone calls, and ignore the letters. Do not go to Missouri if there is a warrant for your arrest they can lock you up if you enter that county. If you stay away from that county in Missouri they can do nothing to you. You can tell them on the phone that they need to come to Kansas, because you don't feel like wasting any gas on them.
EDIT: yes they can charge you with a class A misdemeanor, but if you do not go to the county that misdemeanor was issued in they can not arrest you, and you have no obligation to pay them any fines. |
